  • I am having the same problem as this in Sheffield.  Can I ask how long from PCN to you finding out and was you out of time for the appeal?

The OP hasn't visited the MSE forum for exactly 1 year (02/08/19) so is unlikely to be back - unless they get a court claim. Would be best for you to send them a Personal Message (PM) - click on their username to start the process.

Hi all , You had given me advice re DCBL back in 2019. I had been issued with a parking charge early 2019 from bank park, I appealed as stated via email to bank park and had no response. I then in aug 19 received a legal recovery action letter (certified bailiffs) , following the newbies thread and the advice you gave I ignored and heard nothing until today. Today I have a letter of claim issued from dcb legal, stating the charges have increased to £160, ridiculous!. It was mentioned I would be in limbo and that this may happen within 6 years, I am assuming it would now go to an actual court claim. I have read the thread and searched for dcb legal, I must admit I am a little confused on how to proceed. Any help would be appreciated
I appreciate I may have overlooked it on the threads and apologise if this is the case.
I am unsure if am to send an appeal to this letter of claim or ignore etc?
    Thank you

    Too late for any appeal

The new LBC could be the 30 days notice from dcb legal with the spurious added £60 or more debt collection charge added on and financial forms that you do not fill in , just file away

If that is what you received recently , email a SAR to the DPO at Bank , with a copy of your V5C log book as proof of I D under the GDPR law to obtain all your data , tell dcb legal to place the matter on hold for 30 days whilst you seek debt management advice

A Court claim pack from the CCBC in Northampton will eventually follow in a couple of months time

What to do at LBC stage is fully covered in the NEWBIES thread.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I no longer have the V5C log book as this was a leased vehicle, at the time I was the registered keeper but the vehicle has since been returned. Is it normal practice for me to receive very little correspondence from bank and dcb, but be issued with a letter of claim?

Would I find a template of SAR in the newbies thread? (sorry I find this all confusing)

There's a link to a template in the NEWBIES FAQ sticky, second post.

Send Bank copies of a couple of recent utility bills to prove you are who they are corresponding with and maybe one of their prior letters to you. Don't send anything like your passport or driving licence - too much info!

thank you I have found the post and I'm currently re reading it!. The only thing is the PCN was issued in the name of my business, am I correct in reply with my personal details (bill in my personal name) or should I send a bill with my companies name on it? The 1st appeal I had sent, I had put my personal name at the bottom.
I must add I was not the driver at the time of the charge, when it goes to court will I have to tell them who the driver was?

If you put your name on previous correspondence , it's why they are writing to you and not your business !

The SAR to the DPO at Bank is you as a person obtaining all data that relates to you as an entity under the GDPR law , DPA data , nothing to do with the business !

As a keeper of the vehicle , but a non Driver , that will be paragraph 2 of your future Defence submission

There is no legal requirement to name the driver at any stage , but at this point in time you could consider doing so , because it's too late when a court claim pack from the CCBC in Northampton has been issued to you , in several weeks time

So it's either defend as yourself , or name the driver , with a suitable postal address

At the moment , if it's in your name to an address that you use , then submit 2 recent redacted utility bills for that name at that address
