I have been issued a CCJ and it has ruined my chances for a career in the police.

    I am extremely sorry guys, finding it difficult to use this forum. As I dont usually comment very often.

    I guess that I have no chance in winning, in my statement where I wished to set the judgement aside, I explained my mental health and provided evidence. I provided a picture of the paid parking ticket which did show some random letters (but I didnt type it)
    I did some research and a lot of people said that the county court certificate was fake and I should ignore it. But I didnt. I am finding it difficult to speak to people and have no motivation to do anything other than to look for work. I explained this in the statement too

    But I feel angry because I paid for a ticket and this has ruined my chances of getting a career.

    I will be contacting my local MP because this is making me feel like giving up completely

    I understand that I have to pay the ccj in order for it to be satisfied. I dont understand why I should cancel the set aside and re apply. Isnt a set the judgement aside basically an appeal against the judgement? Or am I missing the point?

    Yes you have misunderstood

    A set aside application is to simply do that - set the ccj aside,

    But once set aside the claimant can then reinstate the claim, though this time the defendant can have his day in court and defend the claim

    Read up about set aside online

    From what you have said you don't look to have grounds for a set aside which is why a set aside by consent is being suggested

    Paying this off will get it marked satisfied

    But it will remain on the records for the 6 years

    The only way to get it removed is the set aside,/ set aside by consent route

    You have very little chance of getting a set aside. An alternative is to get the company to agree to one. It's a lot easier to get if they agree.

    It also only costs £100 instead of £255

    Thank you both very much for the information but if I have no chance to set the judgement a side, can you gove an acceptable example? Its onmy because this hearing is due in October ans I litually have no money to pay towards the ccj I'm struggling to even pay council tax

    if not , the ability to pay is never involved in a court case

    even rough sleepers are "fined" if they break the law, even if they only have 10 pence to their name and no fixed abode

    you are being told that a contested set aside is adversarial and costs £255 and probably requires you to go to court where you may still lose and owe money within one month of the court date , whereas a set aside with consent is passive and only costs £100 plus whatever the court decides should be paid


    we appreciate that you may not have the money, but we can only tell you how it is , what the facts are, nobody here makes those rules, its the MP,s that get to decide on those rules and laws etc


    you need advice ? then you get factual advice with no emotion or prejudice , like medicine that doesnt taste nice , but is the best remedy there is

    Sounds like you qualify for not paying any court fee for this set aside, and thus perhaps you could vary it without cost, to a set aside with consent, instead?

    It's just that we can't see how this can be set aside without consent, because the Judge would need to be satisfied that you didn't get the claim at all, and you did.

    If there's a way to sort this out and proceed with your career, this rotten patch will hopefully become a distant memory .... sell something, beg or borrow. It has got to be worth it.

    What's happening in October? Is it related to your ccj?

    You have been given the option open to you to get this ccj off your record

    However, that avenue does involve you paying the claimant in full before proceeding with the set aside consent application

    So getting the funds together is the first problem you need to resolve!

    Until that's done you cannot start on getting the ccj removed

    I can't offer specific advice to your case, but just wanted to provide some comments.

    I am also a police officer, and I can understand your desperation of thinking this is your dream career and you need to do it right this second. Do not be too disheartened. The police will still be here once all this has blown over. It is just not the right time at the moment.

    I would take this time to get your affairs in order and concentrate on your mental health. This job will chew you up and spit you out. I have seen this job break the strongest of people. Your mental health is of the upmost importance.
