Just WAIT a week after sending the SAR, then tell BW Legal by email you are getting a SAR, that you are aware that TPS has no photo or other evidence whatsoever of any driver leaving any defined 'site' and as such you deny any debt, but that you require them to note that you are seeking debt advice.

Those last 3 magic words get you 30 days on hold. That's why to leave a week in between so the SAR is in with Tito, and the clock ticks on that, first.

I've been drafting a new email/rebuttal for BW Legal which is almost done.
Can i just ask what you mean by in Tito and is it essential that i wait a week as SAR has only just gone today.
BW Legal's 30 days since LOC is almost up sadly, and waiting a week would take me past this.:(

Tito is the MD of TPS but, I have read that he often deals with SARs himself.

    Ah, i see. Thanks again.
  • So, I've received an email reply to my SAR from TPS.

Essentially, all they have sent me is 2 PCN reminders (I never received these) and the section that's supposed to show the 'Evidential Images' are blank white boxes :rotfl:

Apparently a screen ticket was issued - again, don't ever recall having seen one and I'm sure i would have noticed something slapped on the car.

Is it worth emailing them back stating that they're blank and re-requesting evidence of 'Driver leaving the site', or should i just leave it?

As I've now received a response to my SAR, should i now notify BW Legal via rebuttal as discussed?

    Thanks again everyone.

I don't know much about Tito but from what I read on here, he does get his knickers in a twist ?

Go back to him and say that he has failed to provide information to substantiate his claim of "leaving site"
Copy it to BWLegal and request the same info.

And if BWLegal fail to prove this claim, why would they be wasting the courts time and on top of this is abuse of process

Email him back and waste his time. Then report his company to the ICO online, for failure to divulge the very document (PCN) they say was issued to hold a driver liable for a charge.

Sorry, I should have been clearer in my last post. TPS' SAR did include copies of 2 NTK PCN reminders - what i meant was that i haven't ever received these in the post over the years.

The section on the PCN's that are supposed to have a photograph for evidence are blank.

The SAR was sent to me from a data protection officer - what im wondering now is should i email them back to re-request said evidence (if it even exists), or just go straight to BWL as suggested by beamerguy & coupon-mad?

    Yes.

Bother Tito re what's missing and if there were windscreen PCNs, demand them.

  • Quick update on this before I move onto contacting BW Legal:

I contacted TPS again re missing information from SAR and requested the evidential images and a copy of the original windscreen ticket.

They don't have them. They said everything they have has been supplied.

    Jokers.
