One the costs side on the LOC, the 'Balance Due' is £124
This is broken down as:
'Principal Debt + Initial Legal Costs £124
Estimated Interest £23
Estimated Court Costs £25
Estimated Solicitors Costs £50
Total £222

The principal debt is the ticket price, no more no less.
The SAR to TPS will reveal how much that is

BWLegal has added an amount they cannot reclaim

When they say "estimated" are they expecting to add more to these ?
The court fee IS £25
Solicitors charge IS £50

Interest is debatable as the question must be why did they take so long to issue a LoC ?? Doubtful a judge would allow this on this basis

The SAR is not a defence and many that you request will be refused. However you are entitled to pictures of you leaving the site and the a copy of the ticket. Plus a picture of the signs especially those that make mention of "legal" fees being added.
Such pictures must be scrutinised in case they are faked

The rebuttal is not your defence either, this comes later. You deny any such debt and request BWLegal to provide proof that you left the site and you request a breakdown of 'Principal Debt + Initial Legal Costs £124'

Until we know what ££ the ticket is, we will not know just how much BWLegal has added as Abuse of Process

There is no more to be said

Don't send a rebuttal like that to BW Legal. You don't see that ancient old 2017 template linked in the NEWBIES thread, do you? If you do, I must delete it.

Just WAIT a week after sending the SAR, then tell BW Legal by email you are getting a SAR, that you are aware that TPS has no photo or other evidence whatsoever of any driver leaving any defined 'site' and as such you deny any debt, but that you require them to note that you are seeking debt advice.

Those last 3 magic words get you 30 days on hold. That's why to leave a week in between so the SAR is in with Tito, and the clock ticks on that, first.

Hi Coupon-mad

It was a rebuttal that i used for them at the end of 2018 which was advised was okay. I'm guessing things have changed since then? I have SAR ready to email to TPS, but a little confused on what to do in the way of rebuttal (or if that's even still relevant) to send to BWL? Has the 'rebuttal' letter now been changed to sending

Unfortunately my 30 days from receiving LOC are almost up (my own fault) so i'm wondering if i can actually afford to wait a week to reply to BWL after sending SAR to TPS as this will take me past that 30 day period.

I've read some of the more recent threads and again post 2 on the newbies thread, and as best as i can understand once the SAR is sent to TPS, I just need to inform BWL legal of this and ask them to put data processing on hold (they have agreed to do this on a previous case, but i see that they are now refusing these recently) and use the words as you say 'seeking debt advice'. ....it's whether or not i send a simple email OR a rebuttal to the LOC that I'm muddling myself up with.
Also, I'm not sure what 'is in with Tito' means?

In terms of what beamerguy has said below your reply, the part about:
'request BWLegal to provide proof that you left the site and you request a breakdown of 'Principal Debt + Initial Legal Costs £124'
should that go in my reply to BWL (where I've informed them about SAR sent to TPS, or in a separate rebuttal?

Sorry for all the questions & ramble. Not long come off night shift.

BWLegal has made a statement saying 'Principal Debt + Initial Legal Costs £124'

It is your legal right to request the breakdown of £124.
The principal so called debt is the parking charge up to a max of £100. This is why you need to know what that charge was, hence your SAR to the parking company.

BWLegal have been adding fake charges which courts will not accept hence judges kicking out BWLegal for abuse of process.

If BWLegal will not provide the information a court can ask them
• Thankyou.

So, just to be clear on next steps:

SAR to TPS drawing explicit reference to evidence of leaving site and photos of signage, as well as all other info etc to reveal ticket details.

And

Quick email to BW Legal informing them of SAR to TPS and asking them to break down costs as well as putting their claim to proof (and requesting 30 day hold, for what it's worth).

Does that sound right?

This is the new flavour of the month, read this

https://forums.moneysavingexpert.com/discussion/6014081/abuse-of-process-district-judge-tells-bwlegal

The more judges we can get on side the more we can damage these disreputable law firms.

Have you complained to your |MP?
You never know how far you can go until you go too far.

YES

With the current attitude of BWL, they don't like putting claims on hold ... That's OK, more ammo for a judge.

Then you can strike on abuse of process.

Thanks. SAR has now been sent to TPS.

Does anyone know the best email address for BW Legal? Or should i just spam the three addresses that i have for them?

One I found is enquiries@bwlegal.co.uk
For SAR it is SAR@bwlegal.co.uk
Also found Parking@BWLegal.co.uk and DisputeResolution@BWLegal.co.uk
Failing any of those, check any paperwork you received from them.

Unlike Coupon-mad who is a lady and often mistaken for a man, I am a man and am never (well rarely) mistaken for a lady.
