Parking and Property management (IPC)

Hi everyone,

Need your help again. I was recently issues a private PCN at my work car park :( - I have permission to park in any of the bays and have a permit. As the permit is not attached to the windscreen - it must have blown of as I closed the door. The operator is the same and has seen my car parked there several times with a valid permit, but still issued a ticket.

I appealed on the basis I have permission - with a letter from work and a copy of my staff card. I also got work to call Customer Service to try and get the PCN cancelled but they said the person issued the PCN needs to appeal their case.

Its now at IAS stage as they rejected the appeal - just wanted your feedback how to tackle this rather than it going to court.

The rejection letter states that the adjudicator cannot cancel based on mitigating circumstances but on the facts only.

    If you have been here before why did you reveal the identity of the driver? There is nothing to do now except wait to see if they try a claim. They have six years from the date of the alleged contravention to file one. Come back if you get a letter before claim or a claim form. If you move in the next six years make sure to email the data protection officer to let them know your new address. Send them a letter too and retain the free proof of postage from the post office.

    Firstly, because when work called they said they cant do anything over the phone, but seems like an honest mistake and shouldn't be difficult to get it cancelled.

    Secondly, on their appeal website - it does not let you continue with an online appeal when you select owner - only when you select driver does it let you file an online appeal.

    I didnt say as the driver I was given a PCN - my car was given a PCN as the owner.

    Nine out of ten of these so called breaches of contract are scams so complain to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.

    Until this is done you should still complain to your MP, citing the new legislation.

    Remove the link to your rejection letter now it has all your details on it!


    Their appeal site does not mention owner it says registered keeper.



    The car was not given a PCN the keeper was sent a Notice to Keeper, you then outed yourself as driver in their trap website.


    There isn't a way to stop this now other that getting the actual owners of the site or company that contracted these scammers to contact them.


    A phone call will not do you need a paper trail, if your workplace contracted them of course they can get them to cancel.


    Also worth finding out if they have permission to take this to court on their behalf.


    The IAS is a Kangaroo court a total waste of time, I would have thought that as your last PCN was also for permit problems you would at least have been more careful this time.


    Who knows if these scammers will try a punt in court, but this time you may be better prepared, though you need to keep hounding your workplace in the meantime.

    Did you tick a box on any appeal website stating that you were appealing as the driver? Previous posts suggest you did.

    Why on earth did you try IAS? No-one wastes their time with that.

    The IAS is widely known (as a matter of reported fact from lots of bizarre decisions and anonymous 'adjudicators') to be a PPC-scammer-biased kangaroo court; not worth trying.

    I am at IAS stage now - I have another 6 days to appeal to IAS.

    The landowner is my employer - who is on my side. Before I made the informal appeal to P&P management, the land owner called them and asked them to cancel the PCN - but they said they cant do anything and it needs to be appealed through the normal channels.

    The landowner clearly isn't on your side if they won't cancel it, or at the very least inform the ppc that they do not wish this to progress further. That needs to be in writing (or email) as telephone calls aren't worth the paper they are written on.

    An appeal now will be utterly futile.
