VCS issued PCN after 25 days, I told them where to stick it, now DCB Legal have sent me an LBC

    That DCBL Letter of Claim still shows a VCSnnnnnn reference that uniquely identifies you and your incident.

    Also a note to say that I've just emailed an SAR to VCS and am writing an email to DCBL that I am seeking debt management advice and to put it on hold, presumably before I follow Newbies post 3?

    Nine times out of ten these tickets are scams so complain to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.

    You are very lucky they traced your new address. You could have had a CCJ in absence if they had gone to court using your old address. Keep them updated with your current address.

    Yes, it's likely that they re applied for my address even though I had paid for mail forwarding. I just thought that they had crawled back in to their hole, but they re emerged after almost 3 years.
    Still, at least the DVLA have done well out of it :rotfl:

    They have 6 years to pursue a court claim for an unpaid invoice and it's been so since 1973, so only halfway there

    We are currently seeing court claims etc from 2015 and earlier by VCS and others

    Trace Recovery seem to be doing well at the moment

    they have now passed me on to DCB Legal who have traced my new address and have sent me what looks like an LBC.

    So what now.
    You must reply, NOT filling in any forms.

    Deny any debt, deny liability as registered keeper and tell them that Excel v Smith has already established at appeal that a rk cannot be assumed to be the driver nor held liable on any flawed citation of CPS v AJH Films.

    Read Excel v Smith, in the Parking Prankster's case law. You will need it.

    And secondly you MUST confirm to both DCBL (is it 'DCBL Legal'?) which address is the 'address for service' of the claim form, and tell them to ERASE the old address immediately. You cannot leave it assumed or unsaid, you are in danger of a CCJ at the old address and are damn lucky they traced you. Stop hiding and meet this head on!

    You can add a 'rectification/erasure of address data' notice to your reply to DCBL and include it in the email you know you need to send to VCS for your SAR (having read the NEWBIES thread about LBC stage you will know a SAR is needed). So in your case you are also adding for the DPO, a data rectification/erasure notice about the addresses.

    Update July 15th.

    Having emailed DCBL the following yesterday:-
    Dear Sir/Madam.
    I write to you with reference to PCN VCSxxxxxxx on your letter dated June 28th 2019.

    I have written to your client, VCS, requesting an SAR and am also seeking dept management advise. Therefore a restriction of data processing is required and the case should be put on hold.

    I can confirm that for future reference my address for service as the former registered keeper is xxxxxxxxxxxxxx.

    They responded today with:-
    Good afternoon,

    Thank you for email. Can you please respond using pages 7 and 8 on the letter.

    The first thing I noticed is that they have not numbered any of their pages and in fact have supplied 5 double sided sheets. So no way for me to tell what they want filling in, even though they may be trying to obtain more information from me.
    In addition, Interestingly I noticed that DCBL stands for Direct Collection Bailiffs Ltd. So do I treat them as a bailiff (Newbies #4) or does their LOC stand (Newbies #2)?
