    oh, and every piece of information that is handed into a jobcentre is registered on a log - or it should be, as I had my benefit stopped because they said i hadnt returned an IB50 form, and I had, so they looked at thier log to see if i did hand it in and they were proved wrong, it was there in black and white that I had indeed handed in that completed form on the date I said I did and they had to reinstate my claim with immediate effect and they had to give me a counter payment that day for backdated payments that I did not recieve due to their mistake.

    Might be worth your while asking them to check that log? hope you get it sorted soon.x

    Next time you go on holiday....... phone up and say you are sick, miss that signing day and then go back on your next signing day. sorted.
    Heh! It doesn't exactly inspire confidence, does it?

    Of course, if I was really on the ball, then I would have tried to arrange that the holiday didn't clash with the signing day in the first place.

    But I naively thought that it's good to be honest. I thought that if I did everything above board and by the book, then taking a holiday that lasts one week would result in losing benefits for one week - but that's okay, because between me and my relatives, we had budgeted for that.

    Little did I think that taking a one-week holiday, and being totally honest about it, would result in losing not one, not two, but three weeks of benefits!

    And it kinda makes the whole benefit fraud hype sound a bit hollow. We're not allowed to fiddle them, but it's okay for them to fiddle us!!

    Thanks again. Thanks also for pointing out the fact that there's a log. Unfortunately, it seems that the exact details of what I put on that ES40 form haven't been entered on the LMS system.

    But that doesn't surprise me. After all, thinking about it, if absolutely every detail of every transaction was entered on the LMS system, then it would defeat the point of having any other forms. You might say that's a good thing - however, if LMS records were the only records that existed of anyone's needs, then I think it would be very difficult for any benefit decisions to be made at all. So I do think there's a point in having other forms.

    It's a pity these other forms sometimes get lost though, but these things happen. I think you're right - I think the log may help my case. Come to think of it, I think we do have a right under the Data Protection Act to find out what exactly the LMS system does or doesn't say about us.

  • What happened to benefit masters advice about
    "The Jobseekers Allowance Regulations 1996 disagree:

    Circumstances in which a person is to be treated as actively seeking employment
    19.—(1) A person shall be treated as actively seeking employment in the following circumstances, subject to paragraph (2) and to any maximum period specified in this paragraph

    (p) in any week in respect of which he has given notice to an employment officer, in writing if so required by the employment officer, that—
    (i) he does not intend to be actively seeking employment, but
    (ii) he does intend to reside at a place other than his usual place of residence for at least one day;

    That is the specific clause which allows holiday, and DOES NOT specify that the holiday may not be abroad. Clearly residing abroad meets the definitions of residing "at a place other than his usual place of residence "

    Yes, it will be a fight, but yes, I am aware of cases where people have had holidays abroad, been consdiered to be actively seeking for the purpose of section 19(p), and retained right to benefit.

    The Jobcentre will do anything to get you to sign off, including Lying to you. I know, I used to do so for a living. "
