Hi everyone,
After reading **NEWBIES!! PRIVATE PARKING TICKET? OLD OR NEW? **READ THESE FAQS FIRST!** i decided to create a post to see if is even worth it to build a defence.
I have received a letter from County Court Business Centre about a claim from Excel Parking Services LTD that happened on 11/04/2015 when parking in Powis Street - Woolwich (Travelodge Car Park)
I used to live in the area and park here very often, they use a machine where you have to put your registration plate. After parking on 11/04/2015, i started getting letters to pay a penalty for parking without displaying a valid ticket/permit, but i was 100% sure i did.
For my unfortune, i start getting these letter a month after and i did not keep the ticket to prove i did pay.
I asked them to please, send me a report from the machine during the times they stated i was there to prove to them i paid, and see what it was the issue:
1 - Human error from my side, i have made a typo on the keyboard, getting my plate wrong or put the plate number of my motorbike instead my car
2 - Error from their part or the machine itself.
They never came back to me on this so i ignore them.
For 2 year i never heard from them again, and 3 weeks ago i got another orange letter from a collector and this week the Money Claim Online letter.
The only prove they provided was my car coming out of the car park, i guess they have a camera that checks the plates with the machine payments.
I am no sure if i have any chance on defending this, i read all of the cases on the Newbies post, that are similar but not the same.
I completed the AOS today and signed it as "The defendant" cause the "guide to MCOL & how to acknowledge service" link was not working for me when i submitted it, but all the rest look identical.
Any help that can be provided will be very much appreciated.
Thanks in advanced,
Ivan

When you completed the AoS did you put anything in the DEFENCE box, as this should be left completely blank - not even a full stop.0
-
Excel do not issue Penalty notices, they issue Parking charge notices
We hope that you did not put anything at all in that defence box
Email a SAR to the DPO at Excel and get the documents and pictures and data about you and your vehicle at the time, asap
Post the Issue date from the top right of the claim form below0 -
I completed the AOS today and signed it as "The defendant"PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

As Redx said, please post the Issue Date from your County Court Claim Form.0

So i completed the AOS, i did not put anything on the defence box and on the signature box i put the defendant. The issue date from the County Court Business Centre is 10/Jul/20190

Just want to double check that the below will be valid as a SAR:
PCNXXXX
Company XXXX
Dear Sir or Madam
Subject access request
Please supply the data about me that I am entitled to under data protection law relating to:
• My personnel file or any data related to myself
• Any documents from 11/04/2016 relating to my vehicle XXXX
• Any picture of my vehicle XXXX
If you need any more data from me, please let me know as soon as possible. It may be helpful for you to know that data protection law requires you to respond to a request for data within one calendar month.
If you do not normally deal with these requests, please pass this letter to your DataProtection Officer, or relevant staff member. If you need advice on dealing with this request, the Information Commissioner’s Office can assist you. Its website is ico.org.uk or it can be contacted on 0303 123 1113.
Yours faithfully
Shall i signed as the defendant, of keeper of the vehicle in question?0 -
The fact that did not reply to your perfectly reasonable request may well be their undoing in court. If it comes to "he said" "she said" who is a judge to believe, a well known scammer or a fine upstanding citizen. Judges are not fools, they can smell out a scam when they see one.
Nine times out of ten these tickets are scams so complain to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. You never know how far you can go until you go too far.0 -
Shall i signed as the defendant, of keeper of the vehicle in question?
You send it from yourself
You need to edit all the personal and unique information that you have put in your letter from your post!
The ppcs monitor this forum and can use posts in your thread against you in Court0 -
Done, I will send the SAR to them and I will complain to my MP.
On the meantime i just wait and dont put anything on the defence case, but i will have to do it eventually, whichever route this takes.0 -
It is unlikely that you will receive any replies before the due date for the defence so you should start drafting your defence and post it below for critique0
