Advice on estate agent question

Hi all, please could you have a quick scan of the below and let me know your thoughts please, as far as I’m aware the fees are now banned but I’m not sure as whether this is the case here as the initial contract was signed before they were - hope that makes sense, advice welcomed 😄

Good Afternoon Xxxx and xxxx



I deal with renewals here at xxxxx, and your initial fixed term tenancy is ending on 13/08/2019. Would you be kind enough to let me know if you are happy at the property and wishing to renew your tenancy agreement.



We have 2 tenancy renewals:



1st is what we call a Periodic Tenancy Agreement which is a monthly rolling agreement and the only difference from the initial agreement is that tenants only have to give a 1 months notice if they wish to vacate and landlords a 2 months notice is they wish tenants to vacate. The one off payment for this is £72 inclusive of VAT.



The 2nd is another fixed term tenancy agreement which could be for 6 or 12 months. In todays economic climate and with the Brexit uncertainties, I am getting a lot of both Tenants and Landlords wishing to have a further fixed term tenancy renewal for security of tenure for both. So nothing can be done or changed within the term of the tenancy. The cost of this is £150 inclusive of VAT.



Would you be kind enough to appraise me as to what your intentions are. I do know that your Landlord is happy for you to have another fixed term renewal if you wish.

    If you wish to sign for another 6 or 12 months then the fee is still valid as it is an existing tenancy.

    I have no idea how they can expect to charge for a periodic tenancy though, as that is what automatically happens if you don't renew.

    If you wanted to go to a periodic tenancy I'd be asking why they are charging for a periodic tenancy. Legally if you don't sign that happens regardless of if you sign a new agreement or not (i.e justify this cost please, I don't recall any major admin from my time in property management)

    And the brexit stuff is scare mongering. It's encouraging you to pay the higher fee.

    That is some excellent spin right there!


    - as others said, if you do nothing, you will automatically (by law, cant be stopped by anyone except you) have a periodic tenancy

    A periodic tenancy has already been agreed under the existing tenancy, it is your legal right, all tenancies will become periodic at the end of a fixed term. tell them you wish to continue on a periodic basis but dispute the fee as your current agreement already gives you that right.

    Dear Mr agent,

    Thank you for your letter dated xx/xx/xx outlining two of the options open to us.

    Yes, I can confirm that we are happy with the property and have every intention of remaining. The landlord and yourselves have been most helpful so far (no harm smooching a bit!) and the property itself meets our needs.

    We are not concerned about the impact of Brexit with regards to our tenancy, and given that the landlord is happy for us to remain, a Statutory Periodic Tenancy, which will arise automatically on 14/08/2019, will suit us.

    This will also have the benefit of saving both the landlord, and ourselves, from any fees since no new documentation or action is required
