Rejecting a car from dealer
Hi all!
To make things short we purchased a car on the 22nd June from a reputable car dealership. A week later we discovered faults. These was reported to the dealer and the car was covered in the 2nd July. Since then I haven’t had the car back, it needed a new wing mirror, suspension bushes, a pipe reconnecting and the oil leak found has turned out to be a faulty head gasket, a week later! Now I haven’t authorised any repair and have made it clear I want to reject the car due to the extent of the damage under the consumer act. The dealer has refused my rejection, stated we don’t just accept rejections and wants to fix the car, probably under warranty, and possibly buy it back so they can resell it and find me another, which I declined. I issued a letter before action this week giving them an allocated time to refund me. I’ve kept all contact by email for evidence and logged all calls. I’m going to return the courtesy car as well as the log book and keys for the car we bought this weekend. I’ve been told I’ll get a decision on Saturday, my deadline ends Sunday to refund. I’ve spoke to citizens advise and consumer advice and both agreed I’ve taken the right steps. But why do they drag it out leaving you stressed, without a car and straight answers.

Can you clarify you rejected the car before the dealer had it back or was it returned with faults and you later decided to reject it?0 -
It was recovered by transporter the morning after I reported all the faults. Once I got the diagnosis of the oil leak, I then rejected the car0

I did state via email that we would make our decision on the car on the outcome of the oil leak.0

It was agreed that they would recover the vehicle. It’s then took a week to diagnose the fault, after taking it to an external garage as the dealer couldn’t find it. Once I got the call regarding what needs doing I rejected the car. Not authorised repair. The sales manager said he needs to repair it in order to resell it0

I find it odd that people are of the opinion that the dealer HAS TO agree to rejection, of course they don't. If they did you are at their mercy, you are not you have consumer law on your side. It may not be an easy process but the right side will come out on top.0 -

I don't understand the last bit. If the dealer accepts the rejection they can get the car repaired and resell it. Sounds like they are trying to get you to agree the repair and will then say you can't reject it as you accepted the repair.

The sales manager told me they need to repair the car first and then decide the outcome, the most recent update from his was, we still need to repair the car then hoping I will accept them to buy it back from me to put back on the for court, then find me another car. To which I refused, he has then said he will speak to the director Saturday and have a decision. I’ve spoke to citizens advice and consumer advice who have both backed up my decision, stating all the facts.0

And there lies your problem. At that point you should have said no and rejected the car.0
