    No problem

There will be no bailiffs unless a court order was granted, meaning smart would have to win in court and even then only if you failed to pay

This is an alleged debt, so no negotiation is possible

Ignore the debt collectors, they cannot do anything to you

A couple of web searches yesterday came back with advice about when I can and cannot let a Bailiff in and I went straight into panic mode!
You will never have a bailiff knock on your door unless you ignore a court claim, or you defend, but lose, then ignore the cost order awarded against you and not pay by its deadline.

You're never, ever, likely to face the possibility.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

"Citizens Advice came back with help on how to negotiate with the debtors rather than anything specific about how to stand up to the fine,"

Citizens Advice can be very good for lots of issues ...

however when it come to private parking issues they are hopeless and can make things worse :o

I will also try to get my username changed just in case.
To help with that, you might like to read this short extract from The MSE Forum Guide - Frequently Asked Questions & Rules:
    Q. How can I change my username?

    A.
In most circumstances, this is not permitted.

The only reason we will change your username is if it puts your privacy at risk. This usually means you've inadvertently registered using your name, email address or something that gives away your identity within your username.

If you fall into this category, email forumteam@moneysavingexpert.com and request that it is changed, giving three alternative usernames in order of preference.

You dont need to negotiate with DRP...
  • Hi guys, so I have ignored the debt collectors letters and today I received a Letter Before Claim from CST Law asking for a reply or payment within 30 days. Also enclosed is a form to complete asking if I agree I owe, I owe some but not all, I don’t know or I dispute. It also includes Annex 2 Standard Financial Statement asking lots of questions about my income. I would appreciate your advice on whether I need to complete and return all of this or continue to ignore? Recap - I have proof of payment for the parking but with incorrect registration, lost appeal. Thanks and Merry Christmas! X

Do not ignore an LoC , LoC is dealt with in the newbies faq sticky thread post 2

Do not fill the forms in either

If you have not done so already , email a SAR to the DPO at the PPC and attach a copy of the LoC and a copy of the V5C or a redacted but recent utility bill as proof of I D under the GDPR law , to obtain all your data , ideally do it today , 10 minutes work

Reply to cst law and tell them to place the matter on hold pending debt management advice

Then start preparing for a court claim , but wait until after the new year for the preparation , get the holidays out of the way first

Don't complete the financial forms. You could reply (advice in the NEWBIE sticky post # 2) denying all debt and you will see them in court or just denying all debt.

Thank you for the info. I have not had any time today but will get on to it asap, regards.
  • To confirm, I have today sent an email to DPO at PPC requesting SAR and also sent a letter to CST acknowledging receipt of their letter before claim, asking them to place the matter on hold pending debt management advice.

In the meantime I will familiarise myself with the sticky threads including the PD but will without doubt need your help in the new year.

    Thanks JJ
