It's been a while since I have last posted on here. Things have now progressed and I am a little confused so hoping for a point in the right direction and some valuable advice..... so I have recently had a baby and due to personal circumstances have only just got my head around doing something about these letters sent to me end of November.
19th November 2019 I receive a letter NOTICE OF TRIAL DATE which is on 16th January which says unless claimant does by 4pm on the 19th December pay the court fee of £25 it will be struck out.
10 days later on 29th November I receive a GENERAL FORM OF JUDGEMENT OF ORDER. Saying it has been allocated to small claims track and will be heard on a date time set out in attached notice (notice was not attached).
I am confused... has something changed or do I presume 16th is still to go ahead, does it mean civil enforcement has now paid the £25 fee? If not then How can I check this on Thursday (their deadline)
I would attach photos of these letters but I cannot figure out how to do this from my mobile?

None of it means CEL have necessarily paid the hearing fee, as those letters are not led by that. Sounds like one letter should have attached the other, and your local court just forgot to attach it (I am assuming both letters have the SAME claim number top right and that there are not 2 hearings for 2 claims happening?).
Don't bother to check if they paid. That's usually a waste of time. Assume they will, and get your Witness Statement and evidence filed and served in time (the letters do tell you about that...usually says no later than 14 days before).
Search the forum for Civil Enforcement witness statement and read a very recent one.
Also search then for supplementary witness statement £82
and costs schedule
...and copy both documents, as things have moved on and following a case in Southampton in November we now throw the Consumer Rights Act at PPCs to ensure the Judge excludes the fake added costs (which in CEL's case is usually listed as an unconscionable £82 on the claim form).

Fab thanks for your reply. Yes makes sense that these letters should of been sent together I wont worry anymore about that then.
If they dont pay the £25 by Thursday then this will be struck out anyway (I am praying!!!) so I'm thinking I should hold out preparing my witness statement until friday as am I right in thinking I wont have to do anymore if they dont pay?
If they do pay up and I end up having to go to court I'm not sure I can even physically attend. I know I really should but I have 4 young children one of which is a breastfed newborn and I have nobody I can leave her with as partner has to work. I am thinking I may have to just suck it up and pay them :mad: if it comes to this I really dont want to but the time and stress involved may prove too much.0 -
Please stop thinking that they are not going to pay. They will.
Please stop thinking you can't face court. You will! Take the baby with you. The courts will have to make allowances for a breastfeeding mother - it's the law.
I also had 4 kids (I am now a 'University Mum' x 4 and about to go collecting a couple of my sons this week!) and I know there will be someone who can look after the other 3 for 2 hours for you while you win against CEL. It will be half a day.
YOU WILL NOT BE PAYING THE LUDICROUS SUM THEY ARE ASKING, YOU WILL BE SPENDING THAT ON YOUR FAMILY IN CELEBRATION WHEN YOU WIN!

Thank you for your confidence in me I wish I had as much as you! It is a lot of money but part of me just says the logistics and stress etc. To just wash my hands of it. Do you know if I will I be allowed to bring my baby into the court meeting room or not? Just wondering if I will need somebody with me at the court too?
I will search for the witness statement when I can get my head around it this evening I have to start school runs now.

Thank you I did read that of course and I trust that you absolutely know your business I wasn't questioning that I simply wanted to clarify that I can actually take my baby into the courtroom with me and that I wouldn't need someone with me to take her and wait outside whilst I go in. Thank you for clearing that up. I will get cracking with the WS asap0

Look at the pics of the new mum MPs in Parliament this week with their babies strapped to them. Of course you may take your baby with you - it is your right in law - but try to make sure he/she is fed and that you don't get flustered or arrive late.
It would be terrible for your stress to pass to the baby, who screams the place down!
Hopefully we will help arm you with such good paperwork that the PPC will discontinue and you will be excuse the life experience of sitting in front of a Judge!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
