    Considering they are still chasing you and not the new keeper of the vehicle, they still have your personal information. As per GDPR, as an individual you have the RIGHT to request any data held about you from an organisation and to see if they are handling your data in a correct manner.

    A utility bill or your driving license should suffice at most

    Thanks all for points so far. Do i need to send a holding statement or other response to BW Legal? They have requested a response within 14 days. Are there any template responses available for this situation that I could base my response on?

    Your prpoof of ID can be as simple as - youre sending these documents to my address, so clearly I am the data subject.
    Be creative. Youre provinf you are the person named on the documents. Even a utility bill copy would be enough.

    You will see suggestions for replying to a LBC in the newbies FAQ thread

    #2 there covers Court claims right through from the LBC to the hearing

    It's likely that the claim will follow irrespective of anything you write requesting a hold!

    So proceed with preparing to construct a defence (FAQ #2 advises on this too)

    I am emailing a SAR to TPS to get all the info evidence they may hold. Should I email BW Legal to update them and would this be enough correspondance to them at this time?

    So, I have requested the SAR from TPS and am awaiting their response. I also sent a request to BW Legal to put a hold on proceedings until I receive the requested evidence from TPS. As suggested on the forum, they have decided not to accept this request:

    Please note that we are acting on Our Client’s instructions to recover the above balance which remains due and owed by yourself to Our Client.

    Information about the right to restrict processing is available on the Information Commissioner’s Office website. The right to restrict processing only applies in certain limited circumstances. We are not of the view that the right to restrict processing is applicable in this case. Your data is processed for the lawful purposes set out in the Privacy Notice, a copy of which is attached and available bwlegal.co.uk Whilst we acknowledge you have made a request for information with Our Client it is important to note that this does not affect the validity of Our Client’s Claim meaning that Our Client has an overriding legitimate interest to recover the sums due to them.

    As such, your account will not be suspended from further collections activity unless we are instructed to do so by Our Client. Please contact us to reach a suitable resolution.

    They have asked me to contact them 'to reach a suitable resolution'. Do i need to say or do anything more regarding BW Legal at this point, or do i just sit tight?
