Letter of claim from bwlegal

I received a letter of claim from bwlegal yesterday for £160 was wondering if it was different laws if you were from Scotland?
To cut a long story short after landing from Spain on the 26th July 2018 the bus to take us back to the long stay car park was going to be 30 minutes. My 2 sons started to feel unwell because of the really hot day, my youngest son who's 2 started to be sick. We went to get the car to get him out the heat and stopped the car to get them and the luggage in the car. They are saying it is parking in a prohibited area 6.3 but never flying from newcastle before never knew about these laws.

  • Yes a friend of mine says its different if your from Scotland or NI but Im not so sure. I got a reply form and Income and expenditure form as well Ive got 30 days to pay or there will be a claim against me in the county court?

    Everyone is asked to read up on this in the newbies FAQ thread near the top of the forum before starting a new thread

    Go there now where you will see advice for Scottish residents (you are out of jurisdiction of the English Court)

    Very important not to reveal who was driving

    You need to edit your post to remove details of who was driving

    The ppcs monitor this forum and can use posts in your thread against you

    So, are you confirming you live in scotland and the car is registered in Scotland ???

    The problem for BWL then is ..... there is no county court in Scotland, it's a Sheriffs court

    Would BWL be stupid enough to attempt their fake £60 add-on north of the border ?

    Nine times out of ten these tickets are scams so complain to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.

    Yes I live in Scotland and the car is registered in Scotland.

    IN SCOTLAND/NI, CERTAINLY COMPLAIN TO THE RETAILERS, BUT IGNORE THE PARKING FIRM UNLESS YOU GET A CLAIM.

    IN SCOTLAND THIS IS EXCEEDINGLY RARE, AND DEFENDABLE BY A KEEPER, WHO CURRENTLY HAS A FAR MORE PROTECTED POSITION IN LAW THAN AN ADMITTED DRIVER.

    WHEN IGNORING IN SCOTLAND/NI, KEEP ALL LETTERS. DO NOT THROW THEM AWAY, FOR 5 YEARS.
