In the 4th paragraph of the letter it states the following:
'We, the above named company, are the creditor. At the time of this notice we do not know both the name of the driver and a current address for service for the driver and as the registered keeper of the vehicle.'

It specifically states on their letter under the heading Notice to Keeper in brackets the following:
(NON POFA - MNPR - Manual Number Plate Regognition)

A sure fire winner at POPLA then. As long as you don't tell them who was driving that is.

In the appeal only the word keeper was used

Just to be absolutely certain did anything on the appeal page get you to name the driver. By that I mean things like drop down boxes or tick boxes?

there was a drop box in the first line of the appeal with three options:
    I am 'the keeper' appealing
    i am 'the driver' appealing
I am the 'lease/hire company' appealing

i selected the keeper drop down

Then added the keeper before i put my name and address as the bottom of the reply letter

so hopefully they get the point

Looks good for a POPLA win, in due course.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Thanks again to all.

Feeling much more confident that when I opened the letter this morning!
  • I received the same letter and have appealed on line. Now waiting to see what comes of it. Fingers crossed for you.
  • Hi

I can't seem to locate the Newbie thread / sticky - and the FAQ to deal with PCS 'fine'.
Where is it - I need to reply to PCS with the standard templates - but just can't find them.
Sorry to seem a bit dim, but been searching to no avail.
    Thanks
