Solicitor won't Release my cheque for RTA claim

    Who won't do anything until the OP has completed the firm's internal complaints procedure (and it sounds like she hasn't actually started that yet).

    I think the OP needs to make a complaint anyway, there's alarm bells going off and it's a good idea if they were looked at. If I've read this correctly the OP hasn't received information about the firm's internal complaints procedure as they haven't been sent their client care pack.

    I told my solicitor and the senior partner that I was progressing a complaint to the law society and this is when they seemed to be sorting it. I was then asked to call to the office with my bank details so that the court could transfer money into my account. I just don't understand how my solicitor has been paid his fee and he in turn paid the consultants but I received nothing!

    You've flipped that around? It's not about paying client cheques into personal accounts. What was actually said was:
    I don't think it's normal for firms to pay cheques into clients personal bank accounts.

    I didnt mean to mislead. I said I went and signed forms at the solicitors office for a BACS payment to be made into my account and by that I meant by the court. I did say that the court decided to post the cheque instead. It was the court who was making the BACS payment (or didn't make it as the case may be)

    OP - I see you've mentioned the money coming from the court a few times. Had the money been paid into court before you accepted the offer?

    I'm not sure if NI courts are like the ones in England & Wales but it could be that the delay is there rather than with your solicitor.

    Indeed - as has already been said upthread, whatever valid complaints there might be about their communication, you can hardly complain about the solicitors failing to send money which they're still waiting to receive from a third party.

    I think the issue was my solicitor filled a form in wrong THREE times. The money was there but wasn't being released because of his mistake. The initial cheque for £500 was dated 10th May and I received it on 17th May. It has now taken 11 weeks for the solicitor to actually get it right. As i said though he managed to get his fee paid to him on 17th July. I am hopeful my cheque will arrive today!

    It's never wise for anyone, let alone a solicitor, to tell a client that their money's on the way when they haven't even received the cheque! Solicitors need to be upfront and honest, if there's a delay they should tell their client and chase it up yesterday, not leave their client guessing or tell them that they will receive their money next week, then the week after, then the week after etc, which appears to be what's happened here. Common sense and all of that!
