@calcotti Yes, I think we're all pretty much on the same track with this!
@jasonYes, unfortunately until you get a decision on your appeal you'll still need to complete the UC assessment. As soon as you get a decision on your ESA appeal and this is successful upload a copy of the decision to your journal and request that UC revise your award to include that you have limited capability for work. Send a complaint letter too if you haven't got a decision on the new assessment yet.
Have you asked for a home visit? This request can be granted if you struggle getting to places by yourself and you can get a doctor's note or the equivalent recommending to that effect. You could even argue that the assessment providers are discriminating on disability grounds for not providing reasonable adjustments under the Equality Act 2010 if they refuse to give you a home visit and you struggle getting out because of your health.
I haven't asked for a home visit and I'd imagine i'm probably too late to ask for one now for this week. I'm ok with going as long as my mum is able to go with me, and she's usually ok with the journey more often than not but, as you'd imagine, as she gets older this may well become more of a problem. I think sometimes I worry more than I should about her travelling all that way.
As a random aside, I've started reading the assessor's report from my ESA WCA that was held back in January and i've actually only just noticed another inaccuracy or outright falsehood if i'm being truthful.
Apparently I stated I had no issue with consciousness during waking moments which is news to me considering one of the main reasons i've been on ESA all these years is due to a sleep disorder which significantly affects my consciousness during waking moments.
I was awarded 6 points for it at the last tribunal I had as well ..
This is on top of them stating that my glasses "corrected my vision" after I stated that my eyesight had been permanently affected due to a viral infection I contracted two years ago and that glasses could not correct it.
Gotta love ATOS huh ?0 -
Make use you highlight these issues to the tribunal if you have not already done so.
Ideally you should get any written submissions you intend to make to the tribunal service at least 10 days before the hearing.Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.0
