Sending the 1st stage appeal

Copied the template word for word but have to mandatorily select one of these options as the reason for appeal, and a box underneath it makes you tick "The Appellant acknowledges that the facts stated in this appeal are true."

Appreciate this is scaremongering (already made sure to tick "I am the vehicle keeper") but which option should I pick or would it not matter?

    Background - ANPR and P&D (input vehicle reg). NTK arrived 5 weeks after event, no notice on vehicle. SAR sent to PPC and FOI sent to DVLA. Ip/serv is the PPC.

    No that's a good idea, in case you miss a POPLA code sent by email that goes into spam.

    I assume small fry like IPserv can't manage compliant wording for a POFA NTK?

    You tell me! Seems worded well to me but no NTD and a NTK received 5 weeks after incident already means they've failed POFA from what I can tell.

    Well they have included misleading wording based on 9(2)f but have missed out inviting the keeper to pay, or name the driver and pass the PCN to them (and probably other bits from para 9 of the POFA too).

    Odd to take a month to write to you.

    Is it a leased/company car? If so then you should be using one of the lease/company/hire car appeal versions of appeal lower down in the NEWBIES thread, not the blue writing one.

    Not lease or company car.

    Could the PPC "lie" about sending a NTD and claim it was lost in the post?

    An NTD is a windscreen PCN and doesn't come in the post

    Yes, we believe they do lie and cheat due to the vast quantities of first contact NTK,s that fail to arrive in the post, yet reminders always seem to get through

    You are best to assume the worst of any PPC and plan accordingly

    This PPC seem to be new or small fry so expect mistakes or errors to occur
