Do PCM go to court?

Hi guys,

I have recently received a parking ticket from PCM. Now when I received one before from G24 I received good advice on here that they never take people to court so I followed the procedures on here and after a few threats I never received anything else.

Is it the same process with PCM?

I'm planning on using the template on here for my appeal to them.

    With PCM you are likely to need to defend a case filed by Gladstones, so search the forum for PCM defence or PCM claim.

    The appeal will be ignored.

    Try a retailer or landowner complaint first.

    Hi, thanks for the swift response. The ticket was given in the flats where I live and I was told last week by the management company that they would get it rescinded. Unfortunately I've just found out today (2 days before the time period to appeal is over) that they can't do it. So now I'm in a bit of a hurry to get my appeal sorted. I'll have a search for the threads that you recommended.

    They can, you know.

    There is NO HURRY and it WILL NOT be sorted except by the Managing Agent, or later by winning in court. Stop looking for an out that doesn't exist.

    Stop thinking the appeal matters.

    Ok fair enough, sometimes we need a calm head to calm us down in these situations.

    The managing agent said that they are going to email PCM on my behalf but that she wasn't confident of getting it quashed.

    In the mean time shall I appeal anyway, it's actually today that I need to do it by.

    Ask them why it is that the tail seems to be wagging the dog, where it should be the other way round? THEY contracted PCM, THEY can dictate what happens.

    Yes, just state:
    I was told last week by the management company that they would get it rescinded and that they are emailing you in good time to cancel it as I am a resident with overriding rights and easements and the PCN is not supported by the landowner. This is my appeal, as you have no commercial justification or legitimate interest, any claim will fail, so please confirm the PCN is cancelled.

    I will not be trying your notorious 'kangaroo court' stage (IAS) but will claim my costs on the indemnity basis from now on, per letter/time at £19 per hour LiP rate, if you fail to cancel when the Managing Agent has required it.

    Yes, send it anyway. Makes no odds, gets you nowhere, but looks better to a Judge.

    Maybe it's time to give the landowner a bit of a taste of his own medicine, and start getting heavy with him about his unilateral changing of the lease conditions for the individual properties, i.e. imposition of parking restrictions and penalties (sic) paid to a third party for their breach. That depends, of course, on exactly what the leases say.
