VCS - County Court Claim
Comments

Just found this. Hopefully as VCS submitted their request for judgement by default two days after I can get this reversed.
——————————-
Please note that the defendant can still reply to your claim until the court has processed your request. If the defendant’s reply is late but arrives before or even on the same day as your request, it will have priority. It is your responsibility as a claimant to make sure you enter the right type of judgment. If you do not do so this may lead to the judgment being set aside.0 -
lloydie.t, that does look useful. What are you quoting from?0

From what you said, your issue with the Court is nothing to do with the timing of the Claimant's request for judgement.
It's to do with the Court seemingly "losing" your defence after receiving it, and acknowledging the receipt!
What time was it recorded as being sent in your sent emails and the exact time the court acknowledged receipt0 -
Looks as though Gmail sent at 4.01 and receipt 4.030
-
So you were too late to beat the deadline.
Though if it got there prior to the request for judgement then judgement was wrongly entered against you
Are you sure about the date judgement was requested being 2 days later?0 -

Positive. MCOL online shows it as being 31st around 8pm. Also confirmed by letter.0 -
Entrance sign in 2015 was low & covered in foliage, hiding the terms & purported contract.
There's one on the wall on the left, high up but NONE near the bays if that's where the car parked.[/QUOTE]
Hey how do you google an address based on the year?0 -
After 3 or 4 attempts at getting MCOL to look at my case, it has been referred to a district judge (whatever that entails).
FYI, I needed to forward the original defence email and attach the reciept of email delivered (as an eml file) for MCOL to consider my complaint.
In the forwarded email I mentioned the details of my complaint, that judgement had been set 2 days after my defence had been submitted.0 -
Now they will investigate the complaint
(Bear in mind that the date of judgement in default is not the date judgement was requested)
Your defence needed to be there in time (which it wasn't) or prior to the request for judgement0
