    Subject access request (Data Protection Act 2018 / General Data Protection Regulations (GDPR))


    Joe Bloggs, 2 My Street, Somewhere, AB12 3CD. Registered keeper of vehicle YZxx ABC.

    Please supply the data about me that I am entitled to under data protection law relating to myself. The following particular information is required.

    · -All photos taken on the day of the apparent infringement (with time and date stamp clearly visible)
    · -A close up of the signs in the car park on the day in question.
    · -Evidence that you have paid any debt collectors and Legal fees that you may be trying to recover from me
    · -Any and all previous correspondence that you have sent or received relating to this
    · -A PDT machine record from the day mentioned above
    · -All other data held, including a full copy of the PCN and NTK

    If you need any more data from me to confirm my identity, please let me know as soon as possible. It may be helpful for you to know that data protection law requires you to respond to a request for data within one calendar month.

    If you do not normally deal with these requests, please pass this letter to your Data Protection Officer, or relevant staff member. If you need advice on dealing with this request, the Information Commissioner’s Office can assist you. Its website is ico.org.uk or it can be contacted on 0303 123 1113.

    That is not personal data and is not recoverable via a SAR.

    Why not email your SAR to VCS as suggested in the NEWBIES thread?

    From their Privacy Notice:
    If you would like to know more about our Privacy Notice or wish to know what personal data we hold

    So even though the Vehicle registration number supplied in the letter attached to the email, an email has been received requesting it again so that they can correctly identify the owner.
    The excuse:

    We hope you will appreciate a search under your surname returns a number of PCN accounts

    Really, first name, postcode, etc. could not point them in the right direction. Or even read to the next line where the Reg number is.

    There has been no further response from VCS regarding the SAR. The completed acknowledgment of service was submitted on 01/07/2019.
    Am I right, that having completed the AOS there is 28 days (+5) from date issued to complete a defence?
    If VCS fail to provide the information can I use this in defence?

    KeithP's post tells you your deadlines.

    You are in the same position as most defendants and would not expect the SAR back yet and would just defend without it, if it gets close to your deadline.

    Read lots and lots of VCS defence threads and learn from them and what happens and how to later shoot down their template WS and evidence.

    Don't look for exact same location/circumstances, just read VCS claim threads and learn, as they are all much of a muchness and easy to pick holes in their evidence later.

    Spend some time doing that and it will also help you formulate a defence.

    If the SAR deadline is before the Defnce deadline, then of course state that the C has failed their oblgiations under the DPA2018 by failing to provide information ... within the 30 day deadline. This has prejudiced your ability to form a full defence.

    It uis not a *defence* to the charge.
