My DD has not been disciplined yet as she has asked for a solicitor to be present. They have now said they will not take the matter further but she cannot apply for any promotion

Who is the ‘they’? The AM, HR, someone else?

I would be very surprised if the company would allow your daughter to bring a solicitor, another member of staff or union rep is normal but if they were not available I would still expect her to attend any meeting/ disciplinary about the incident. If she refuses to attend that would add to her woes.

If she has been called a "bloke in a dress", did she object to it at the time and raise a grievance about it? Is there a discrimination angle to this too? Any place I've worked for the last 35 years would not tolerate such homophobia - presumably there is CCTV to back up this like there is to the cardboard box incident.

My other daughter is a solicitor, as soon as we mentioned her and wanting someone present at the disciplinary the AM back peddled and changed her mind about having one. The AM has given a piece of letter headed paper to my daughter with the following:

"Whilst viewing the CCTV I saw XXXX stomping on cardboard and then picking up a pair of scissors and repeatedly stabbing the cardboard with them"

I wonder whether this has even been sent to HR and my daughter has now requested a copy of her work file.

She has not reported the "bloke in a dress" comment until now - there is no CCTV footage for this incident.

So by what authority can the AM dictate this? And is this verbal or in writing? Definitely a matter for HR!

I can see how the story is changing now.

I'll bow out and wish your daughter good luck in the future.

    Hi,

has your daughter seen the cctv that AM refers to?

Yes, she has seen the CCTV - she can see herself breaking up the cardboard box...but at the end of the day it is just that - a cardboard box and a tough one at that. She has to break up the boxes, it's part of her job but she wasn't aware she had to take into consideration it's feelings.

This is a joke but we just wanted to make sure if she complains it will be taken seriously

I'm not sure what you mean about the story changing?

I can't post the full details of what has happened over the last 2 years as there are so many examples and it would take a long time. I wanted advice regarding the cardboard box incident and what people thought about this accusation.

My daughter is an adult and she is progressing this issue herself, I have an account on MSE hence my question
