PIP awarded - wrong rates?

Hi Everyone,

After a long journey through the DWP maze, I just got the brown envelope with a letter explaining that I have been awarded PIP - standard rates for both components. This was a new claim.

The letter states that the rates are of £57.30 and £22.65 for daily living and mobility respectively.

Is this a mistake as an internet search reveals that the current rates are £58.70 and £23.20?

I will be asking for a Mandatory Reconsideration as I believe I have enough points for Enhanced Daily Living.

Do I mention the rates in the same letter for MR or a separate correspondence?

    Those rates are for before April 8th 2019. This means that any backdated money owed before those dates will be for that rate. After this date will be the new rates £58.70 daily living STD and £23.20 Standard mobility. Have another look at what the letter states.

    Letter says £57.30 and £22.65 paid from Dec 2018 to Nov 2021.

    No explanation around how backdated money was calculated, except for the dates they were calculated for.

    The rates quoted are the rates applicable at the start of the claim - December 2018. From April the rates will have increased.
    Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.

    I assume you mean that you think you should have been awarded enough points for an Enhanced award.

    If you do actually have enough points (12) but have only got the Standard rate that's a clerical error which you may be able to get rectified by a phone call.

    How many points does the letter say that you've been awarded for each part?

    The DWP and factually defective letters eh. I suspect the issue of the annual updating won't come to fruition. I would be inclined to ignore that.. do sums on what you are owed in backdating and seeif it is close to what you get... and then going forward payments should very clearly be with current rates and evidenced via your 4 weekly transfer to bank account.

    But as above... unclear from your wording whether they've made some error in adding up Daily Living activity descriptor points or if you think they haven't got the right descriptors for all activities (leading to less than the 12 required for enhanced rate). I assume the latter... obvious a MR would carry some risk as would an appeal beyond it that you end up with a poorer award. The chances are though generally low of that... and if you think you can make a good case for higher scoring descriptors on some activities... and even better evidence such... then certainly consider it. If you haven't already got it.. get the assessment report (assuming you had one!) from DWP via number on PIP letters... as it is likely any argument for descriptors applying will somewhat contrast with opinion in the report.

    OP - What points were you awarded and for which descriptors.

    Why do you think an enhanced award should have been awarded?
    What additional points should you have got, and on which descriptors.
    Do you have compelling medical evidence to support these additional points, and to counter the assessment's rationale for not awarding these points?

    Are you prepared for the possibility that a second DWP decision maker might remove your current award at MR stage?
    Can you cope with the stress of managing an appeal on your own?
    Do you understand the appeal process?
    Have you validated your understanding of those additional PIP points against the DWP's PIP Assessment guide (part 2).

    Calcotti is right. Have calculated according to the 2018/19 from the claim date and 2019/20 rates from 08/04 and the amount in my bank account is correct! Yay!

    Regarding the points, I didn't get awarded points for descriptor 9 when I have 8 points for communication (descriptor 7). I feel it is because the HCP did not understand my condition well and will therefore request the MR. I have found caselaw to support my arguments.

    I take it that the OP believes they have enough points to get Enhanced as they have looked at the points system, self assessment, and should have more awarded
