I think instead of arguing over their valuation you should be grateful that your insurance are even considering paying anything. No MOT means your insurance is invalid

... My car is a BMW 5 Series Saloon 2008, 525i SE manual patrol, with 80k miles on the clock. The car has been well looked after and it comes with FSH (last serviced by BMW end of April, 2019) and has lots of extras like exclusive red leather Nappa seats, nav, metallic paint etc....
    ...
The extras don't add much (if any) value on an 11-year old car, unfortunately.

What value comes up if you put the details into we buy any car or similar?

Does anyone here has any idea on Financial Ombudsman's timeline if I were to challenge this and lodge a formal complain/review?

You will have to go through your insurers complaints process first, which could take up to 8 weeks then whatever timeline the FOS are working too.

Potential option is to accept the current offer as an ‘interim’ payment, i.e. you’re not agreeing to full and final settlement of the claim, just asking they pay their current offer as an interim and them argue for an additional payment afterwards, via complaint, FOS etc.

That’s not the case, driving an unroadworthy vehicle will usually invalidate your cover, but that’s not the same as having no MOT.

Indeed...would you expect and be willing to pay more for a car that has a 12 months MOT compared to one the has 30 days left? There is value in the length of the MOT.
An 11 year old car with no MOT is worth to many people £100 a ton mixed metals at the crusher

If you are going to make posts get your facts straight, no MOT does not invalidate any insurance.

If OP wants this resolved they need to do some work and find out what the market value of the car is. It is no good just saying the offer is not high enough. The FOS has ruled previously that a deduction from the market value is reasonable for having no MOT but 10% could be considered excessive depending on particular circumstances.

As some of you have already mentioned and I agree 100% it's difficult to evaluate a car, but if I look around definitely I would not be able to replace my car with what they are offering for something similar age and mileage.

You might be able to if you look at cars of a similar age and mileage with an expired MOT, which is what your car was.

I had an accident 2 weeks ago as I was driving my car to the MOT centre (the day after it expired)

Why did you leave it so late to do the MOT? Did you know you can take a car for an MOT a month early and get 12 months from the date it expires (if it passes).
