CCJ that I didn't know I had due to parking ticket that I knew nothing about!!

We are in the process of applying for a rented property and the letting agents came back to me this morning to say there's a ccj on my credit file. I was shocked as I knew nothing of this so did some digging and it turns out that while I was in hospital after having my daughter my partner has got parking ticket while driving my car, probably in the bloody hospital! I couldn't physically drive as I was very ill post c-section. All the correspondence from the company, "civil enforcement", went to my old address as we had just moved and I probably hadn't updated my address with the dvla at that point. The ticket was issued on 27/06/16 and the ccj was put on a year or so later. What, if anything, can I do about this? I don't want to pay £315 and I don't particularly want it on my credit file for another 4 years! To say I'm fuming is an understatement!
Thankfully my partners credit file is fine so it will just be him on the tenancy agreement and not me. 😒

All you need to know is in the stickies.
Nine times out of ten these tickets are scams so complain to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. You never know how far you can go until you go too far.0 -
firstly , make sure the V5C and driving licence updated details have been done regarding addresses, or its a fine of up to £1000 for each offence
then go to the NEWBIES FAQ sticky thread at the top of this forum, third thread down , scrll down to post #2 and read up about the £255 set aside that you need to make
this will probably then mean you will have to defend the original pcn charge in court, plus try to get all your costs back
this default CCJ to an old address is well known by CEL , so many others have come here with the same issues, read those threads too, to see how they went about it
you will need to get this done quickly, or you will fail to secure the set aside
also email a SAR to the DPO at CEL with a copy of the V5C to get all their docs , pics and data held on the keeper0 -
Thanks for the replies. I informed the dvla that we'd moved but possibly not by the date of the ticket. Does this mean I can't do anything about it?0

No, read all of Redx's post and you will see that you can do a set-aside; check it out in the NEWBIE sticky as advised.ohwhatapalaver wrote: »Does this mean I can't do anything about it?0 -

Can I just query, if I do nothing with this, as I have done nothing for two years as didn't know anything about it, will the ccj disappear from my credit file after the 6 years are up? Will the 'debt' disappear? Or will they ever try and find me again? I've got so much going on at the moment with moving house etc that I can't entertain the prospect of having to go to court to fight this.0

If you do nothing then the debt "drops off" after 6 years. They may or may not bother chasing it.
If they don't do anything for 6 years then they would have to reapply to the court to enforce it. They would need a very good reason for doing this.0 -
The Claimant has up to six years to enforce the Judgment.0

but in the meantime , they could apply to enforce it because it is a court order0

Thanks, so it probably won't make a huge difference if I wait a couple of months to think about it properly.0
