    Unless your courier can't prove they tried delivering to the correct address, I think you're worrying needlessly.

    Most likely someone who messed up and is trying to win their ex back - who is having none of it.

    Of course, despite being exempt from the right to cancel - the contract would still need to meet the other requirements of the regulations. Such as providing certain information to the consumer (assuming not ordered from your physical premises in person) before they are bound by the contract, including that they will not benefit from the right to cancel (and also the arrangements for delivery & performance).

    Well, I don't really like giving advice to business owners but I would give thought to:

    - Giving some leeway where possible (is it a big deal to send out free replacement ones? Or heavily discounted ones? Or cost-price ones? Or ones at full price but with free postage?). It would help your reputation :)

    - If you want to stand your ground, simply just stating no refunds and let them either go away (unsatisfied) or start MCOL action against you (in which case you can put your case forward and a ruling will be made).

    I'm still not sure if they've asked for a refund and you haven't responded yet or if they haven't asked for a refund yet.
    Unless your courier can't prove they tried delivering to the correct address, I think you're worrying needlessly.
    I tend to agree with this ^^^^.

    Having a quick look at other florists t & Cs admittedly ones who often use local florists to deliver, they request the telephone number of the recipient, and offer to redeliver as long as the repeat delivery charge is payed.
    If you’d have had the phone number this could have been avoided, or at the very least you could put the onus back onto the purchaser if he didn’t provide it.
