Can I Claim On Company Insurance

Hi

I'm not sure if this is the right place to post this so apologies if not but could do with some help please?

In May, I won a place through Etihad airlines at work (I'm a business travel consultant) to play football at the Etihad Stadium in Manchester and just into the 2nd half of the game, I was tripped and split my collarbone ending up in A&E and having to have surgery to repair from which I have been off work for eight weeks.

With me representing my company, should I be able to claim on their insurance for the accident as when I asked my manager, I was advised that as I had to take a days holiday for the event, I wouldn't be covered?

My argument is that when I have been fortunate enough to win trips to the USA and have had to use holiday to go on these, I have been covered by the insurance but never had to claim.

Also, if I had gotten into an altercation/fight playing the match then I would be severely reprimanded as I would be representing the company.....

Can anyone offer any advice or thoughts please? I'm not after tens of thousands or anything like that, just enough to cover my loss of earnings as am on SSP?

Sorry if this is not the right place to post but any thoughts or advice would be much appreciated.

Thank you

Andy

If you were on holiday at the time, then I'd suggest you wouldn't have been representing your company, so you'll need to claim off your own insurance.

I had to take the day to part as annual leave but was still representing the company as it was an event for travel agents....

But this was in your own personal time and not work time.

I appreciate what you are saying but so were three trips to the USA that work have covered me on their insurance for - each I have had to take 8 days annual leave for and they were in my own time too?

What happened previously is irrelevant. From what you say you were not carrying out the duties of your employment (and purely voluntary?)so why would you be covered?

Who was it who told you that you were covered previously?
Do you have it in email/writing?
Is is a travel insurance policy?
Did your trip to manchester involve a flight? How many days away? (Just asking because some UK trips are not covered by travel insurance).
Does the insurance policy cover you for personal accident? (most travel insurance policies don't - only medical).
Why do you think your employer offers personal accident cover? (that isn't standard even on company business).

Have you actually contacted the insurer/broker?

In this scenario wouldn't you need to claim against the stadium though? So you could appoint a no win no fee company to claim directly through the stadiums insurance. Although if you were playing a sport, I would think there is a risk of injury so might not be able to claim anyway.

I think the OP is talking about sickness/accident insurance, not a personal injury claim for negligence.

But not entirely clear what they are expecting.
Travel insurance policies don’t usually cover lost earning only medical/travel expenses.

Not sure what insurance the OP thinks his employer has.

Whenever I’ve travelled I’ve had a copy of the employers travel policy (as you might for example need emergency numbers).

Ah I see, that will teach me for not reading the post carefully! I'm stumped then, I also can't think what insurance they could be thinking of.

What insurance are your trying to claim off? Is it the Employers Liability insurance your employer has or do they also have a Personal Accident policy which covers you?

Who was the football match organised by? Your employer, Etihad or a 3rd party event organiser?
