Rear shunt not at fault

Hello.
I had an accident two days ago.
Guy behind me haven’t kept his distance and once I stopped before to turn left he didn’t paid attention to the car in the front of him(mine).
He admits full liability of the accident and I have his statement on a paper.
My car is damaged at the back but still drives.
I have insurance with DIAMOND INSURANCE.
I called them and reported the accident in the same day.
Driver at fault have insurance with AXA INSURANCE.
They gave me two options:
0. Making a claim thru my own insurance company and pay the excess (quite high unfortunately). No replacement car during the repair would be provided.
0. Making a claim using their own associated Accident Managment Company - AUXILLIS. I would pay no excess fee and I would receive a hire car.
Based on this I decided I’ll go with option number two.
However once I read thru documents that they send me via email to sign and then they would proceed with everything I noticed that it would be a hire repair credit and hire agreement which its not at my favour in case in third party at fault insurer would not accept all liability so I’ll not agree for their terms and conditions. I’ll call them to tell them that I’ll be not using them because I do not agree with repair credit agreement that they offer and they have bad reviews.
So my options are either:
0. Claim thru my own insurance, pay the excess and claim it back later on.
0. Contact the driver at fault insurer and claim thru them as this is his clear fault.
Is the option two the best possible solution ? Would the driver at fault insurer be at my favour?
My car is on a finance with option to buy at the end and I have a care plan that should cover me for write off so I wouldn’t have to pay for finance if car will be write off.
Do i need to contact the company I have my car on finance with ?
Do I have other options in this case?
Please advise me what I could do in this case as this is my first accident.

claim direct off the other insurer. If non fault and claiming off your own though you should not have to pay any excess.0

Thanks for your opinion.
In my policy says that even accident it’s not at my fault I have to pay compulsory and voluntary excess which would be around £1000.....
So still would be better to use my own insurance instead of the driver a fault ?0 -
The easiest way is to go through the other party's insurance. If you decide to go through your insurance then you will have to pay your excess which will be refundable when the claim is settled.0

are you sure:

I had a car run into the back of me, I didn't have to pay anything up front, when the claim was settled "no fault" my no claims bonus was restored and my excess was paid by the other driver.
I decided my insurance company would look after me better than the others drivers.0 -

Just claim directly through the other drivers insurance company.
Quick and painless.
You as the injured party can take your car any where you want for repair and the insrance company will pay them direct.
Unless there is a dispute, never ever use a claims manage ment companymake the most of it, we are only here for the weekend.

Claim through the other parties insurance. If they went into the back of you then liability is clearly with them and they will want to minimise costs. They will most likely offer to provide a hire car and get your car sorted.
If you use your own insurers accident management agency they will add on their own fees, they will secure a hire car at a very inflated rate that they hope the 3rd party insurers will pay (if they don't as you noted you could become liable for this as they want you to sign an agreement stating that you would be liable for any unrecovered costs). The 3rd party insurers will be very keen that you do not use an accident management company as this will end up inflating the claim massively (with you covering the risk of non-payment).
Phone AXA and explain that you have been referred to an accident management company by your insurers but you would prefer to deal directly with them. I am in the same situation, rear ended 10 days ago. I am with direct line and rightly or wrongly I claimed via DL so last week they took my car away and Auxilis provided a hire care.
I went down this route as DL will not be making me pay any excess, and they aim to have my car back within 7 days. I have since had a recorded delivery (I not give him my phone number) from the other guys insurers offing a free hire car and repair at a a repaired of my choice.
A bit late to change my mind now as far as repairs are concerned, I could hand the hire car back, and get one from the other guys, but I will only need it for 3 or 4 more days so I can’t be bothered with the hassle of doing that.0 -
