So you now know the date by which you must file and serve your Witness Statement and evidence. Is that right?

Good. Don't miss that target date, and file a Costs Schedule then too.

In the County Court at XXXXX
    Claim No. XXXXXXXX
    Between
    Civil Enforcement Ltd (Claimant)
    and
    Scooby82 (Defendant)

    Witness Statement

    1. I am Scooby82 of [Address], [Postcode], the Defendant in this matter. I will say as follows:

2 On [DATE], I visited Frankie and bennies and parked my vehicle registration no, XXXXX in the car park.

    3. Restaurant users are granted exemption from parking charges whilst using the Restaurant When entering registration number in the keypad in the restaurant

    4. I entered my registration number as requested on the signs in the restaurant and as reminded by the staff when being led to our table

5.I have video evidence to support that I was indeed eating in the restaurant

6.Upon receipt of a parking charge notice from the Claimant, I offered to supply them with this evidence, however they have elected to pursue this matter

    7. I invite the Court to dismiss this claim in its entirety, and to award my costs of attendance at the hearing, such as are allowable pursuant to CPR 27.14.

Judges have disallowed all added parking firm 'costs' in County courts up and down the Country. In Claim number F0DP201T on 10th June 2019, District Judge Taylor sitting at the County Court at Southampton, echoed an earlier General Judgment or Order of DJ Grand, who on 21st February 2019 sitting at the Newport (IOW) County Court, had struck out a parking firm claim.

    Statement of Truth

I believe that the facts stated in this Witness Statement are true.

This is where you put that evidence in = the video and photos and case law that your defence referred to originally. You don't just say 'I have evidence'.

    This is it now.

Also you haven't even touched upon the fake added costs that caused double recovery.

See post #14 of the Abuse of Process thread by beamerguy, where I wrote some wording for everyone to use at WS stage and I give the links to 2 judgments where the added £60 'debt collector damages/costs' were kicked into the long grass.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Should there be a sentence between 3. and 4. saying something like "the driver entered the registration number on the keypad as requested"?

  • Hi Scooby82.
I don't know if this will help you.
We successfully our recent case against this PPC because they didn't provide any proof of the right to operate.
All they evidence they gave was in the witness statement which simply stated that they had permission to operate.
They did not say who had given permission nor provide any further evidence.
They sent the witness statement early which gave time to do some research.
In our evidence and witness statement we heavily challenged their right to operate.
    The case was dismissed.
