Thank you everyone, appeal submitted! Now just have to wait for a verdict
Also, my flatmate has gotten a parking ticket at our hospital accommodation (managed by a different firm from the actual hospital's car park firm). UKCPM, an IPC member, therefore IAS appeals route. We've read that the newbies thread recommends not appealing through IAS at all unless exceptional circumstances, however, there doesn't appear to be a list of what classes as an exceptional circumstance?
Anywho, the windscreen PCN was given on 23/07/19, appealed on on 06/08/19. The rejection letter was sent well after 28 days on 24/09/19, should the PCN now be classed as void? Is that good enough grounds to appeal to IAS or should he not bother?0 -
Please don't try and progress two entirely different issues in the same thread. That can only lead to confusion.
I suggest your flatmate signs up to MSE forums and starts a new thread.0 -
a pcn is never "void" as its only an invoice and an alleged debt that is "forever"
however, the statute for enforcement in england and wales is 6 years , so its statute barred and effectively "void" after 6 years, so a long way to go
so assume its not "void" until 6 years have passed, bearing in mind that POFA is not mandatory0 -
Exceptional circs for trying IAS on this forum can be counted on the fingers of one hand, and have included one I recall when the parking firm tried to hold a person liable who doesn't drive and was not the keeper of the car either - and it was proved.
Not otherwise, and the person has no need to start a thread about any IPC firm, until they get a court claim. It is that simple, court will kill the scam. Appeal will not.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
