Options
Hi Guys,

As i type this i just recieved a notfication from my credit report company that i have recieved a CCJ on my file today?

I dont know who it is from as i received no notification or letters at all. The date on my file says 21/06/2019 for the CCJ

1 - How can i contest this?
2 - How do i find out where the CCJ is from without paying for a service
3 - Does the CCJ wipe off from my file if paid within 30 days of it entering my file?

Any help Much appreciated

    Morning,

1: apply for a set aside but cost involved https://www.stepchange.org/debt-info/ccj/set-aside-ccj.aspx
2: contact the court that issued it and ask which company put it on
    3: Yes

Sounds like an unpaid parking invoice. Have you moved address in the last Three years?

First thing is to see which court issued the CCJ (most likely the Northampton CCBC as that does bulk of most CCJ) and call them Monday and ask which company requested the CCJ, then go from there.

I just got a letter today in the post confirming my CCJ, (Lowell). However, i had no prior letter at all telling me they would be issuing me one or a chance to explain and make an arrangment or even defend myself in court.

I believe this is not normal procedure, as they must give you written confirmation.

    Thanks

They have to send you a letter notice of intention to litigate, then one outlining action and giving you 30 days to reply, after this a claim form will be sent by the county court and if no response they can request a default judgement after 14 days.

So never got any letters, or just no letter saying could get a CCJ?

These mysterious and unknown CCJs are usually as a result of an unpaid parking ticket or water bill. People often don't receive the Pre Action Protocol paperwork because they have moved home. Have you moved home in the last few years and not updated your address on your drivers license for example?

no, been at the same address many 15 years. I dont think its a parking ticket etc. Infact looking over paperwork i believe i have found the debt, its an old loan from many years ago when i got in financial difficulty. So that is not a problem. The main issue is they issuing me a CCJ without any notice or letters. I found out through my credit report.
  • No notice or letters like your default letters you never received?
