    Well low and behold, today, the Notice to Keeper finally arrived in the post (issued 29th July according to the date on the letter). It was so poorly printed etc, that they'd actually cut off some of the writing from it, and the photos of the car were so blurry, you couldn't see much other than the number plate.
    Enjoy the little things, for one day you may look back and realize they were the big things.

    What's the gap in calendar days between the parking event and the NTK arriving (not being posted)? And we assume APCOA haven't yet learnt how to word a POFA version!

    Received on day 65, nine days too late for keeper liability to apply. Even the issue date is too late. :T

    "A Parking Charge Notice (PCN) was issued to the aforementioned vehicle. The driver of the vehicle at that time is required to pay the parking charges in respect of overleaf. However, the Parking Charge Notice has not yet been paid.


    As the Parking Charge Notice remains unpaid, vehicle keeper data has been obtained from the Driver and Vehicle Licensing Agency (under Regulation 27(1)(e) of the Road Vehicles (Registration and Licensing) Regulations 2002). They have provided the details overleaf as the registered keeper of the vehicle at the date and time of issue of the Parking Charge Notice. If you believe your data has been used/provided inappropriately, you can notify the DVLA by contacting 0300 790 6801.


    As we do not know either the name of the driver or their current address, you should either pay the full amount outstanding as noted below or, if you were not the driver of the vehicle at the specified period, provide us with the name of the driver and their current address. You should also pass this notice onto them. If you sold the vehicle prior to the date shown overleaf, please provide us with the details of the person to whom the vehicle was sold as well as proof of sale. If you are a Hire Company please provide the name and address for the Hirer along with a statement signed by or on behalf of your firm to the effect that at the material time the vehicle was hired to a named person under a hire agreement, a copy of the hire agreement and a copy of a statement of liability signed by the hirer under that hire agreement, within 28 days of the date of this notice.


    A charge of £85 is payable and must be paid before the end of the period of 28 days beginning with the date of this notice.



    APCOA Parking (UK) limited ('APCOA') will us the personal data it collects (including the vehicle registration) to obtain from the DVLA the registered keeper's name and address and to send a Notice to Keeper, any related correspondence and any further notices if this Parking Charge Notice remains unpaid. You have 28 days to pay this Parking Charge Notice from the date on which it was issued. After that further action may be taken. It is in APCOA's legitimate interests to regulate the parking in this car park. Also, by parking here you have entered into a contract which includes an agreement to park in accordance with the Terms and Conditions of Parking and you agreed to you information being processed for this purpose as part of that contract. The personal information may be shared with APCOA's payment enforcement contractors and with the person who appointed it to mange the Car Park if relevant. The information may be retained for up t o 6 years following the completion of processing. If you are concerned about how APCOA is using the information, you can contact the Data Protection Officer via dpo@apcoa.com or on 0345 301 1151. More information about your rights concerning the use of personal information is available on our website https://www.apcoa.com or via the Information Commissioner www.ico.org.uk"

    If it contains a Popla code, use it and construct a pofa heavy appeal

    If you haven't appealed yet, then do so using the blue text template from the newbies faq sticky thread, as keeper

    ...... and probably as well as not having the capacity to put up a decent argument against the motorist's appeal.

    I wonder why?

    Hopefully the new Code of Practice will place financial penalties on those PPCs that withdraw at the last minute (POPLA or Small Claims Court) having made motorists jump through a series of unnecessary hoops.
