    The same applies to the s172 offence: points are applied only in the cases where the RK does have a licence.

    Yet we create a driving record for foreign nationals when a graduate fixed penalty carrying points is issued.

    Because they (presumably) have a licence/Driver Record in their own country.

    This discussion was originally about the fact that parking a car with no tax & insurance on the road is an offence committed by the Registered Keeper and not by the driver and having a licence is not a legal requirement for being the RK.

    But you do realise if you drive without ever applying for a licence you get points for driving otherwise than in accordance. That's points on a licence you've never had.

    See Post 1 - the car was parked on the road, there is no driver, the car had no MoT, was not insured and was declared SORN. S144A of the Act is entitled “Offence of keeping vehicle which does not meet insurance requirements”. This requires ONLY keepers of vehicles (no mention of driver) to ensure a policy of third party cover is in place at all times unless the vehicle is declared (and kept) off road by way of a SORN. The original post does not involve a driver, a licence or any points so although your post is factually correct it is of no relevance to the OP.

    But not impossible to be charged with using a vehicle without insurance. Fine and 6 points.

    I'm not, if it's on the road it needs insurance and is being used.
