Did your Nan get fined for not registering the births?

I believe she did, was threatened with court. Can't believe she managed to not have them registered in all those years.

    Same here.

We were told to destroy the originals as it was illegal to use them.

I've kept the original certificates as I like genealogy.
Although we wasn't told it was illegal to use them.
Just that if anyone applied for those three certificates the later one would be the one sent.

Until comparatively recently an illegitimate child was legally without parents - 'no one's child' - so could not inherit from blood relatives unless specific provision had been made.

This is fascinating! My children, born 2007, 2009 & 2011, are illegitimate. Their father and I are getting married soon, but feel it unnecessary to re-register their births. So when you say recently, do you know if this would affect us?

A number of changes to the law made between 1926 and 1987 now mean that for practical purposes (e.g. inheritance) illegitimacy is no longer an issue.

However - re-registration of the children is a legal requirement (under s9 of the Legitimacy Act 1976). The registrar should remind you when you go to give notice to marry if they are aware that you already have children together.

I had never seen this until looking for OH’s brother’s birth certificate. He was illegitimate but re-registered three months later when his mum and dad got married.

I had no idea. I thought it was just a nice thing to do so the names matched on the certificates. Thank you.

It doesn't matter - illegitimacy is not longer relevant for most legal purposes (Unless you or your partner are members of the royal family or the aristocracy, asit still matters for inheriting titles and the right to the throne!)

Technically you are required to re-register them following your marraige (although you are under no obligation to change either you own, or their surnames - if they have your name that doesn't change unless you want it to!)

However, lots of people are not aware of the requirement and as it no longer makes any diffrence to things such as inheritance rights it's not as importnat as it was in the past.

If he hasn't already got it, your partner will get parental responsibility for the children when you marry .
