My reason for posting is to get the OP the best help possible, thats usually achieved by complaining about the product or service in question.

It matters not a jot if the bank is entitled to do something, whats important is if the banks actions were fair on the OP given the circumstances, or not.

Thankfully more reasoned heads than yours will decide the outcome of this matter, so i wish you all a good weekend.

Thankfully the more reasoned heads will not include you as your advice is wrong and not for the first time either.

Interesting that some posts now appear to be missing...

Strange that they should be deleted when they've been quoted in full by other users.. :)

I'm slightly shocked. A month ago I received notice that I have approx £3300 in PPI refund owed to me from a Natwest loan. As I have had to stop working due to chronic fatigue this was a real relief. However, a month or so passed and no cheque came. I contacted them yesterday only to discover they have apparently set-off this payment against the loan. I was horribly in debt some 15 years ago when I had the loan, yet I used a debt advisor and did a full and final settlement on all my loans. Natwest did not inform me they were doing this and I am appalled, I really needed this money to help my current situation. What can I do?
You can complain by Post to:

    Customer Relations Manager
    7-10 Brindley Place
    Birmingham
    B1 2TZ

You require their response in writing within 8 weeks.

It's good practice to send them a reminder after 4 weeks

If you are not happy with their response, or you do not get one, you refer the whole thing to FOS using this form:

The OP will need to show compelling reasons for contesting the offset though. Only if the OP can show they have pressing need for this money (due to financial hardship?) are they likely to have the decision overturned.

Unless OP has ‘priority bills’ in arrears then nothing is going to change, the bank was well within its right to offset (both morally and legally).

Giving OP incorrect advice is pointless and leads to false hope, they can of course complain but FOS would only consider if evidence of priority debts in arrears could be produced.
