When items are returned via the eBay system there will be tracking, my returns have always tracked successfully and I refund as soon as it gets back to me. If tracking shows seller has had item returned then eBay will force your refund through if you phone them. I don't know though what happens if item doesn't reach the seller, as a seller though and knowing how eBay deal with sellers, I suspect you would get a refund as long as tracking shows Argos has returned it, even if it never reaches the seller.

I lost my case because the seller sent the item signed for to Argos which was signed for when it arrived. He showed this proof to eBay who told me it had been delivered and I was not given a refund.

I'm going to appeal it and see what happens.

PS. I'm not going to use click and collect again and I won't be offering it on my listings eithers.

Appeal by phone, you really need to ring and explain that the item hasn't been collected from Argos. Don't muddy the waters with reasons why....keep ringing until you get it resolved.

I agree , I thought this was an automatic win for the buyer, until the activation code shows as collected the item is not deemed as received by buyer when Argos C and C is used. All of mine that weren't collected by buyers showed the return clearly with tracking and I was told to refund on delivery or else ebay would do it for me and I would get a defect. That's why I stopped using C and C via Argos, I couldn't continue to pay out postage for people who just didn't bother collecting, it was running at about 1 in 3 went uncollected which was ridiculous.

Phoned up, got passed from pillar to post but finally got my money back.

The money was returned by eBay LTD and not by the seller. Does this mean the seller got my money and the item returned as well (he's got it listed back on eBay now) or will eBay make him fork up?

Thanks again for your help folks. I'm not using click and collect again as a buyer or as a seller.

Ebay won't make him fork out for the refund, you will have been paid from Ebay's purse. They tend to iron it out as a no fault refund to you both

I have also stopped using C&C.

I sent an item to a customer via C&C as they had requested. They asked me where it was. I checked and confirmed the tracking and said it was signed for by X person at Y store on Z date, so it should be there for you to collect.

Customer said the store denied it being there. Long story short, customer opened and won the case including a full refund - I was stunned. The tracking shows it was delivered to and signed for at the C&C shop but I still lost the case.

A cautionary tale for you all. Oh, and I didn't get a refund from the courier company because as far as they were concerned, it was delivered and it's not their problem.

Did you appeal like the OP? The OP gained a refund in the end.

When you get a message saying that the "item is ready for collection" there is a note that the store will keep it for 7 days before sending back.
My local Argos store is happy to keep it longer if you phone them. So if you actually want the item but cannot get there on time, there is always an option of phoning them. I use it on regular basis and the store manager recognizes me...
