Hi
I live in Scotland and received 2 parking tickets at the hospital I work in, where the car park has contract signage e.g. 3hr car park but there are no charges for any car park, instead you must obtain a free parking ticket. I ignored all debt letters.
I have now received a Simple Procedure Notice of Claim, effectively our small claims court. What to do????

This is very rare. Is this Horizon parking?
One of the very few we have had on here was won by the motorist. Here is an account you might find useful https://forums.moneysavingexpert.com/discussion/5912977/horizon-simple-procedure-scotland&highlight=simple+procedur%20%20e0 -
How does the 3 hour rule work for staff? Surely they are not expecting Hospital staff to abandon their posts to go and move the car out then drive back in and re-park and get another ticket?
If so, I would be partly using any Unfair Terms legislation that you can find applies in Scotland, and the fact that parking in Scotland at hospitals is free, has been for a decade or so, and the word 'free' means 'without charge' and this certainly implies that NHS staff cannot possibly be penalised and intimidated by demands.
The will of NHS Scotland and the Health Secretary has been clear since 2008:
https://news.gov.scot/news/free-parking-saves-patients-over-25mHealth Secretary Shona Robison said:
“The founding principle of our NHS is to have services that are free for everyone – services that are not out to make profit.
“That’s why I’m delighted that getting rid of car parking charges has saved patients and staff over £25 million.
"Charging to park at hospitals was an unnecessary financial burden on families and those needing treatment at a difficult time.
"Health boards are also continuing to work hard to put plans in place for addressing potential increases in demand, the promotion of greener transport and the possible misuse of spaces by commuters or others.
"I would like to be able to abolish charging at the three PFI car parks too but, unfortunately, these facilities are locked into long-term contracts with operators which precede this Government. We continue to keep these under review.”
is this Ninewells?
Who is the Claimant? Aggressive & infamous NHS-staff-rinsing UHW claimants, Indigo?
https://theferret.scot/snp-government-did-not-fully-end-hospital-parking-charges-in-2008/But three hospitals were not included in the scheme: Ninewells in Dundee, Glasgow Royal Infirmary and the Royal Infirmary of Edinburgh. The reason given for this decision was that car parking was provided as part of Private Finance Initiative (PFI) contracts which were too costly to buy out.
Ninewells parking is run by Park Indigo Infra Dundee on a 30-year lease, Royal Infirmary of Edinburgh is administered by Consort on 25-year long lease, while Glasgow Royal Infirmary is run by Impreglio on a 30-year deal.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It's Smart Parking0

The hospital is Perth Royal Infirmary. There is a staff car park, which is never full, including the overflow one. To get a permit you have to have extenuating circumstances such as living out with a certain distance of the hospital or some kind of disability, or selling your soul.
It really boils my blood to have to pay these people, I hate them, they are the scourge of the earth. I want to avoid paying them all together, but I have to reply to court by 31/07 with either disputing the claim or admitting it and asking for more time to pay.
What should I do? I don't understand how there can be any financial loss if there was no cost in the first place.0 -
Read the Beavis case
Do SMART know who the driver was ? Answer Yes or no0 -
That's not a yes or no answer.
Best edit it!!0 -
Are you stating that there has been a GDPR breach in making that assumption ?
Smart do not know where you or anyone else works
They know the name and address of a keeper registered with the DVLA against the VRM of your vehicle
I agree with Quentin, yes or no was the response, not speculation or written admissions
Less is more, and too much information can damage your bank account
For all smart know you employ a chauffeur same as Tooker off dragons den0 -
This a short extract of what Pete Wishart MP for Perth and North Perthshire had to say about Smart last year in the House of Commons:The city of Perth is plagued by these cowboys. I have received more complaints about one car park in Kinnoull Street than about any other issue in my constituency. That car park is operated by the John Wayne of all the cowboys, the appalling and loathed Smart Parking, a company that blights communities throughout Scotland, including Inverness, in the constituency of my hon. Friend the Member for Inverness, Nairn, Badenoch and Strathspey (Drew Hendry). It distributes fines like confetti, and its so-called smart technology seems almost designed to frustrate motorists and harvest fines from them.
You might want to let Mr Wishart know about your predicament too.0 -

I'm struggling to work this site, I keep clicking edit but nothing happens?
Anyway, I have written to Pete Wishart and read the Beavis case. There is no cameras in this car park, there's one solitary man that does it all old school with a wee machine, nor have they provided any evidence of the parking ticket being stuck to my window.
In the claim I received from the court it doesn't state any date or time of the contravention either.0
