OSPS letter before action

Hi,

OSPS have incorrectly rejected my first cashback claim, and are refusing to honour any future claims.

If I send them a letter giving them 14 days to pay up before I go to the small claims court, where should I send it to? Does anyone have a better, more official address than the PO Box that the cashback claim went to?

I tried searching the MSE forums but couldn't find an answer to my question.

I'd be interested to anybody's past experience in this situation. Do they pay up or do you need to go to a small claims court.

If I take them to a small claims court, can I claim for the complete GBP360, since they have said they will not pay any future claims, or do I have to do it once for each claim?

Thanks for any replies.

Don't send it to a PO Box.

Their Registered Office (Registered via Carphone Warehouse):

    One Stop Phoneshop
    c/o THE CARPHONE WAREHOUSE LIMITED
    1 PORTAL WAY
    LONDON
    W3 6RS

Have they breached the contract by not paying you, despite you making a valid claim?

If so, this is a relevant breach, and you can claim the full amount due.
  • I don't know why it was rejected - there could be all sorts of reasons now. However, there are many threads under E2Save and OSPS on this, plus some bits I've put together here:-

OSPS is part of cpw and now actually IS E2Save.

My letter to the above address did the trick. I received a phonecall from OSPS soon after, they agreed to honour my claim, and a cheque for the claim arrived today. :j

I think they were calculating dates from the order date, even though the agreement said 'connection date' which was about a month later due to porting issues. So when my claim arrived a month later than they expected, they wrongly rejected it. All sorted now though.

    Thanks for the above replies.
