Don't ignore, just take no action, file away the letters safely as this may point to unreasonable behaviour or harassment. If you have not received everything you put in you SAR submission report them to the ICO.

I think it's fair to say that BWLegal have finally gone off their trolley.

Probably the pressure they have in trying to prove the validity of the fake amounts they add to claims

They still fail to prove what on earth they are talking about, I'm sure the courts would welcome an explanation, thus far nothing is forthcoming

They've gone back to being polite but still want money. I'm thinking I will reply to say that the SAR was incomplete and didn't answer my queries and that unless I hear from them in 14 days I will consider their and their clients actions harassment so will begin a claim against Armtrac and their agents as well as reporting Armtrac to the ICO. One thing Armtrac told me is that they weren't able to give me a copy of the contract regarding the car park because of data protection. Is this standard? I'm happy to have a redacted copy and I've told them that.

Frustrating as it is dealing with incompetence, don't bother with harassment, it's difficult to prove with high bars attached. Plus harassment is long word, they probably won't understand.it.

By all means tell them they failed the SAR and warn them if they continue to fail, the next step is the ICO

You already know your defence for ABUSE OF PROCESS as in coupon-mad's post # 14 OF THIS THREAD

Getting BWLegal spanked again in court and claiming your costs should be enough pleasure for you

Excellent, thanks. To be honest I'd stopped reading the threads as I thought they'd seen sense and given up!

This is childrens game nowadays .... the child being more intelligent

As they say "you can't take a horse to water and make him drink"
    BUT A JUDGE CAN

Trust you have heard about the multi millionaire who asked his 3 sons what they wanted for Christmas

The eldest son said he wanted a boat, so his dad bought the QE2 for him

The second son wanted a music centre, so he bought him the Albert Hall

The youngest son asked for a cowboy outfit ? so he bought him a parking company

So I got a reply from Armtrac to my follow-up request for all the information they hold on me. They said today that they have given me everything they have.
    I asked for:
    - All data held
    - All photos taken
    - A full copy of the Parking Charge Notice (PCN) and Notice To Keeper (NTK)
    - All letters/emails sent and received (including your correspondence with the DVLA to obtain my personal details and any appeal correspondence)
    - A PDT machine record from XX, which must show all payments made, and partially redacted VRNs, with sufficient information to protect full disclosure of other VRNs but enough letters or numbers to establish and identify if a payment was made
All evidence you Armtrac intend to use against me (to include - a copy of the contract with the landowner under which you assert authority to bring a claim against me, a copy of the alleged contract with the driver, a plan showing where the signs were displayed, details of the signs displayed).
A close up of the signage at Sennen Beach Car Park on XX
Evidence that you have paid a debt collector to chase me
A list of all PCNs you consider are outstanding against me

    They have sent:
    - photos of the vehicle on the day in question
    - a mocked up, back office copy of the PCN
    - pictures of the signage (all of which are actually just the signs, not shown in situ)
    - a birds eye view of the site.

If this is truly all they have, how can they send letters, threaten court etc?

I had threatened to contact the ICO but as they have replied saying this is all they have. I am wondering if I do it anyway as it just seems fishy that they have instructed lawyers (I know BW Legal aren't really lawyers) based on so little from so long ago.

I just want the letters to stop.

That is all they would divulge at this stage; I wouldn't expect to see more. The landowner contract is not your personal data, and comes later on at WS stage.

Same lack of evidence as in all BW Legal cases.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Can I ask you if you have been taken to court as I am fighting a similar thing.

So, after the reply saying they had sent me sufficient info with the original SAR they sent me another LBC. Identical to the one sent in May 2019.
I replied (on 15th Jan) as I replied to the first LBC and received the same response as to my first response to LBC.
"Please note that the matters are currently on hold pending further instructions from our client, you will be contacted in due course."
I am fully expecting either a court letter or to wait another six months and get a similar fishing response.
A solicitor friend told me that the not valid after 6 years doesn't stand if they have contacted you. I assume the contact is to keep resetting the 6 year clock.
