can someone help me prepare the defence
    Thanks a lot
Your defence is a cut-down version of the account that you've given us, assuming you haven't left out any important details.

Were you told about the cancellation fee when you booked? If not, state this.
Were you told that full payment would be due in the event of you not keeping a booked appointment? If not, state so.
Did you make your order conditional on the fitter arriving by 2pm on that first day? If so, state so.
Explain that you gave them a further opportunity to arrive by 6pm and that after then, you would be out. They arrived at 7.30pm - well outside 'normal' hours and long after your first deadline. It is not you that failed to honour the appointment, it was them.

I've probably missed it but did you supply the blinds and employed a fitting service?

    Thanks to all of you,
But Please I wondered if I could have real help in preparing the defence. I am not familiar with the lingo and also if someone could help with the cunsumer rights if its applicable here to be included in my defense.

I bought the blinds and asked for installation services.
    Thanks

If you want 'real help', consult a solicitor. No one can do much more for you based on the information you've provided. See my last post - those are the questions you need to answer. Simply set out a brief, factual account of exactly what happened, what you were told by the fitting company and crucially, anything you were not informed about. Don't add in all the stuff about the meal and your elderly mother. Stick to the facts.

    Hello Aylesbury,
As much as I appreciate your help pls dont try to speak for everyone.
I am wondering if this is just solely your responsibility to answer every post here. If you can't help please refrain from posting. There might be someone who could be of more help. The whole point of this forum I think is to help people with these issues. if you can't do please STOP typing some sort of unnecessary advice.

  • OP ideally you need to read through and understand the details at the link below regarding the right to cancel a distance contract:

    https://www.legislation.gov.uk/uksi/2013/3134/contents/made

and look at what information the regs state must be provided against what was actually provided by the company plus look at the information regarding cancelling a service.

If you post (a bullet point of facts) on the consumer rights board:

Hopefully Unholyangel will see your post and advise exactly on what is required and where you stand, they are most knowledgeable poster on what the regs exactly require.

I don't see how me posting is stopping others from posting. I'm not a moderator. Asking you pertinent questions to help you make your case is certainly not unnecessary and the fact that you don't like being asked relevant questions and want someone to do all your work for you is itself rather rude.

Feel free to ignore me, I really don't mind, but I will continue to post as I wish to, within the rules of the site of course.

Would you care to explain how their posts are preventing others from helping, this is an open forum and as stated anyone can post providing it is within the rules.

Doesn't bode well for any potential court case!
