Which CRA are you looking at? It states the default date in the account data. What was the date of default?

April 2012, when it happened but it keeps updating every month new default date, more than one CRA
Nothing has been fixed since 2008, it was just pushed into the future

An account can only default once, the default date will be shown, the status just updates every month thats all, if it defaulted in 2012, it should not be showing now, do as advised last year, dispute the entry with the creditor first, as they provide the info to the CRA`s.

If I contact the creditor I’m worried they may view this as acknowledging the debt and the six years will start again

What is the default date, if the account defaulted, the default date will be clearly shown.

If there is no default date, it didn’t default, simple as that.

  • Advice from a person once in your shoes, you could do nothing and wait for it to drop off. Or dispute it. Please don’t live in fear. Once it’s gone past 6 years there’s generally little they can do. They can still pursue. BUT you might be better placed to discharge the debt. It’s not ideal
  • Ask for proof of debt. See if the agreement is enforceable. It the answer to both is yes then claim statute barred due to 6 years. They can keep selling the debt on and on. It just depends if you can be strong and ignore it. Who is the lender and how much is it
  • If your scared of Contacting the Creditor don’t worry they defaulted it back in 2012. Write to the Creditor to Provide Paper work and prove the debt. (Don’t Phone, put it in black and white)

They won’t be able to as no court in the land will enforce it now, they will remove the debt from the Credit file. It might be just a case of Not showing that your file has been updated yet as your credit file is normally 3 months behind. Hope this helps.

  • Hope this is ok to post here or should I start a new thread?
I am in the same situation with a creditor--default was reported in Oct 2012 so should have dropped off or been removed now but it hasn't and the lender keeps updating the report each month.
What status should the lender now tell the credit reference agencies--from the list on Experian's website, I think Partial Settlement is the closest but there isn't a status that seems to say Account closed with no payment made.
The lender seems to think it can keep reporting this just because the debt is still owed, which it is, but I know they can't keep reporting it as it's over six years.
    Thanks.
