    If the aircraft has changed the available seats you saw at time of booking is irrelevant. How do you expect the to honour seats that most likely don't exist?

    Are the T&C's you quote only for a refund of the amounts you paid for pre-selecting seats, not the whole holiday?

    TBH, if your wife is so nervous of flying that sitting in an aisle seat means cancelling an entire holiday Mexico was never a good idea.

    The aircraft hasn't changed. The compromise on flying to Mexico was that she would have a window seat which I booked and was confirmed by TUI. Only a deposit has been paid therefore that is what I require to be paid back to my account.

    You only need to look at FB/Watchdog etc re TUI and you'll understand why you're on a non-starter with this. They won't have accepted as a condition of your booking that your wife has a window seat therefore no chance of a refund for the whole holiday (and only if you're very ucky will you get one for the seat booking fee)

    Other than that you can join the back of the queue of those suing TUI :rotfl:

    I've not paid for the holiday, only a deposit which I wish to be refunded

    ...which you wont get. You are probably entitled to a refund of the extra seat allocation fee and that is it.

    May I ask why is it essential she sits next to a window on a journey there which is mostly over ocean, and on the way back which will be mostly pitch black?

    If it is a different Aircraft you get the money back, similarly, with most Airlines if they move you , also give you a refund. , not sure about TuI

    Have you tried this number 020 7048 0143 Tui fly call centre, tell them she is a nervous flyer.

    He doesnt want just the money back from the seat allocation, he wants the money back he has paid for the main body of the holiday.

    However on my dummy booking earlier there is no way of knowing if window seats are available until you click through and pay the deposit, so he is on a hiding to nothing here unless he booked it in shop and its different there.

    what are the t and c relating to a refund of your deposit assuming you are talking of cancelling the whole holiday ( which is crazy)
