Unsolicited Goods?!

Hi there, I was talking to a man regarding the sale of a jacket. We spoke about a price. I sent him my address so we could calculate shipping costs and work out a deal. He came back to me with a figure to which I responded "I'll think about it." About a week later he has posted the product without my knowledge and is telling me that I am to pay him now that it has been delivered. He is threatening to involve authorities or even come to my address to retrieve the product. Am I within my rights to keep the product, not return it and pay for it?

    Firstly they are not unsolicited goods so you can stop googling those.

    I assume you mean by your last post you want to NOT pay for the jacket and keep it.

    No. You have to give him his jacket back. Of course you can’t just keep it. You can ask him to reimburse the postage cost.

    Also why not let him come collect? It’s his! It’s not a threat to come and get his stuff back...
  • I was under the belief that if a product has been delivered to me without my intention and knowledge that I have every right to keep this? This is only what I have read from the Unsolicited Goods Act 1971

    Given your obvious interest in the jacket I doubt you could truly call it ‘unsolicited’... and I very much doubt you’ll be able to keep the product for free.

    You are incorrect.

    If he sent you the jacket randomly, intending to ask you for payment later then yes.

    You discussed it with him. You gave him your address.

    You are now attempting to steal the item. He can involve the authorities or come to your home to get it back.

    Give it back. It’s not yours.
  • No I simply made an enquiry. He was only given the address to calculate shipping costs. We never confirmed a deal. He sent the item and presumed I was just going to pay.

    No matter how you spin this it will never be unsolicited goods. These are clearly goods sent by mistake..

    You needed to have ZERO prior contact. You will never win this.

    Surely a wind-up? Of course you can’t keep it (unless you pay for it). Look up the definition of “unsolicited” as well.
