Apcoa pcn

Hi guys I have been reading the newbies thread and have a question. The driver received a windscreen pcn whilst parked at a hospital in the past couple days. Reading through the newbies thread, it has been found not to appeal to the PCN until around day 26? Reading other members' threads regarding APCOA pcn's, it seems regular posting members have told the OP to ignore as APCOA do not sue/take to court. Is it best to ignore or use their appeals procedure with the blue text in newbies thread (APCOA is a BPA member)? If the best course of action is to use their appeals procedure and use the blue text in newbies thread, should it be done now or is it better to wait till after day 26?

You are best advised to follow the guidance offered in the NEWBIES thread.

Whilst at the moment APCOA don't appear to sue anyone, remember they have up to six years to work out how to do that.

You may have seen ignore advice in relation to train station apcoa PCNs

But as Keith advised, follow the FAQ advice on how and when to appeal

    Nip it in the bud.
What about complaining to PALS - look on the hospitals website for further info.

Thanks for your replies...when complaining to the hospital (PALS), is it a good idea to also make a polite but angry complaint to the chief executive?

Yes, it sometimes works, I've done it myself for people. Read and cite the NHS CAR PARKING PRINCIPLES first, as they've breached it. Do NOT say who parked the car.

However, as this is APCOA it is a nailed on win for you at POPLA. 100% certain.

So if you do not complain to PALS it won't matter, as a keeper will always beat APCOA by using our template appeals for each stage (longer one for POPLA stage - see post #3 of the NEWBIES thread and any APCOA POPLA thread. There is one from today on here (read it now, although it's not a windscreen PCN and was a byelaws site, so a different one from yours) but it's so easy to win v APCOA it's like taking candy from a baby...
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Should I skip the APCOA appeal stage and use POPLA immediately in this case?

You can't access POPLA unless you've already appealed to APCOA, had it rejected and received a POPLA verification code from them.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Have you read these/

    Are they compliant?

Nine times out of ten these tickets are scams so complain to your MP.

Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

You really need to read the NEWBIES thread if you thought that's possible!
