I can not do periodic as I don't earn enough. I have been paying 6 months upfront, which is no longer viable. Need to pay monthly hence why adding partner.
Just start paying monthly. The only thing they can do is evict, which they will be unlikely to do if you are paying on time0 -
So if you have been paying 6 months up front that means for the last 6 months since you paid you could have saved the amount of the rent ready for now.
So if you don't have this money it sounds like your in financial trouble because you can't afford your rent. If you carry on like this you won't be able to afford your rent even monthly, so i hope your doing something about this!.
I do have the money to pay upfront but don't want to continue doing this as its all my savings, then start saving again for the next 6 months. Yes I struggle financially which is why I want to control it monthly.0 -
How did they stop you going on a periodic tenancy and what reason did they give?
As Comms69 says, they have no choice and cannot stop you going periodic once your tenancy term ends, it is your legal right.
Have you tried contacting the landlord direct and asking him/her without going through the agents?0 -

They cant. The law is the law. If you're choosing to not listen, then I don't understand why you asked for advice?
But to clarify:
If you do nothing, you will automatically be on a statutory periodic tenancy (or contractual periodic tenancy). There's nothing anyone can do about that.0 -

Unfortunately when your tenancy commenced it was agreed on the basis that rent in advance would be paid at each renewal stage due to affordability.

You have 3 options;
- Do as the agents instruct
- Do not do as they instruct and pay monthly in advance
- Do not do as they instruct and give notice
I think they are taking the urine, you have history and have paid the rent.
Ultimately as you are not in Scotland the landlord can evict you without reason, so it's up to you what you want to do.
There will have to be a new tenancy agreement if you add your partner on so the current laws should apply.
The agent are trying to have their cake and eat itbaldly going on...0
