Tenants rights

I am currently renewing my tenancy, having new references done to add my partner to tenancy.
As I’m a current tentant they are saying they can still charge me £420 although the laws changed. Please can someone clarify that for me. Thanks

    What does it say about charging fees in the contract you currently have?

    My understanding is that if you have fees written into your current contract,these can still be charged up until 31may 2020.

    If you don't have fees written into your contract the charge is no more than £50 if you instigate the request to alter
    in S 38 T 2 F 50
    out S 36 T 9 F 24 FF 4

    2017-32 2018 -33 2019 -21 2020 -5 2021 -4 2022

    If you are still in your fixed term or in a periodic agreement fees can still be charged till 31st May 2020 providing they are listed in the agreement.

    Interesting one this one as my experience is you don't normally take someone on or off a tenancy agreement, you normally create a new tenancy agreement so in which case it would not be allowed.

    The government didnt really think about it when they brought in the ban, it actually can put tenants in a difficult situation, if someone wants to move in or out someone needs to pay the lettings agent fees, a landlord may refuse to allow someone to be added or taken off because they would incur a fee for doing so.

    This makes it difficult for one tenant to leave a tenancy agreement without having to end the tenancy risking the other party being removed. At the same time if an extra tenant moves in and is not on the tenancy agreement this is a breach of the tenancy agreement and again can put the tenant in danger of eviction (Although unlikely).

    They have made the same mess up of the 5 weeks deposit, often landlords will except a larger deposit for a higher risk person, that could be because of debt issues, between jobs temporarily or even having pets. The government have now made it very difficult for those people to get a house.

    I can not do periodic as I don't earn enough. I have been paying 6 months upfront, which is no longer viable. Need to pay monthly hence why adding partner.

    You can. Because they cant stop you. It happens by law.


    You don't need to add your partner to simply pay monthly. I will bet that the contract doesn't stipulate a 6 month tenancy period.

    So if you have been paying 6 months up front that means for the last 6 months since you paid you could have saved the amount of the rent ready for now.

    So if you don't have this money it sounds like your in financial trouble because you can't afford your rent. If you carry on like this you won't be able to afford your rent even monthly, so i hope your doing something about this!.
