Retailer refusing to accept TV return less 30 days

    This would have had me running a mile. CC processing fees are as little as 1.5 - 2% and debit cards as little as 20p per transaction. Certainly nowhere near the 10% discount on offer (unless they only accept Amex!)

    Sorry to say, but it sounds like you've been scammed by them.

    Sorry but bank transfer would also me running a mile.


    No harm in trying small claims court, cant say what your chances are.


    You could speak to your bank but I suspect they wont be able to reverse the payment.


    In future don't use bank transfer for purchases like this, always credit or debit card.

    Just LBA them, they will almost certainly give in before going to a small claims they have no chance of winning.

    One thing I would say is it might be you who has to pay for the return postage. Normally if the product is faulty is the retailer who has to pay, but as they are selling them as Grade A, they could argue there is nothing wrong with what you bought (the faults are priced in) and you are returning for change of mind.

    What's LBA?

    They claim the faults was not there when sent and that they keep cctv footage for all goods sent. i asked them to provide it but they stopped communicating. I also said I'd just pay the return back to them and they said they will refuse any delivery attempt .

    each time I got replies it was someone new but all of them seem real nasty bits work :/
  • 1/ A bank cannot reverse a funds transfer. Ever.
    2/ They are offering a discount for payments other than for card payments. For consumer cards, this is now illegal (they are effectively charging a premium for payment via card).

    I thought they was for business that are owed money?

    I already emailed them a templated letter stating the law of the consumers act - that was on 30th and what finally got my my first response and since then nothing but trouble from them refusing everything ...

    Should I actually post them it via royal mail recorded?

    No, because then they can refuse to sign for it.

    Post 2 copies from 2 different post offices, and keep proof of posting. They will be deemed to have been served 2 days afterwards.

    Laughable really because now less than 30 days on they are refusing a return and my right to cancel.


    From the gov guidance on payment surcharges
    13.3 The government considers that, if a discounted price is offered for the use of any
    means of payment (whether that is a means of payment to which the Regulations
    apply or not):
    • that same level of discount must be offered in all situations where regulation 6A(1)
    applies, so that there is no surcharge; and
    • the difference between that discounted price and a higher price charged in any
    situation where regulation 4 or 6A(2) applies must be no more than the cost the
    payee faces in processing the means of payment in that situation.
