Faulty second hand car advice needed

    My opinion of the trader is purely based on my conversations with him to settle this matter & the fact he resorts to intimidation. When I mention consumer law, complaints procedure or ADR he does not understand what I'm talking about. I expect a reputable dealer would have a procedure in place to deal with these issues. No ones being a xenophobe.

    Buying from him was a mistake which I live to regret. In future I will be more dilligent in my approach or buy from a national dealership. I'm waiting for the outcome of the dpf investigation by vw from there I'll pursue a section 75. If all else fails court action then upgrade to the sheriffs.

    Plenty of white Anglo Saxon rogue traders out there and plenty of good "foreign" traders too.

    Did you send a formal Letter Before Claim? If you did I see no point in faffing about sending more letters.

    If you didn't send one then you need to.

    For the dealer to use intimidation & threats of violence to discourage me to pursue this further is not acceptable & not allowed under the consumer rights act.

    1. I contacted the dealer on two occasions to report the fault he refused to repair or refund.
    2. I instructed a VAT registered garage to repair the nearside window & change brake fluid which cost me £339.
    3. I sent a LBA to request he pay my costs or resort to court action.
    4. He called me on the weekend in which he used threats of violence if I continue further. Also denied receiving my LBA. Royal mail tracking shows he did.
    5. CAB want me to send another letter because I had some repairs done. which is a waste of time. The dealer already refused a repair or refund. He has not provided me details of his complaints policy or ADR details. I only aggrevate him more.
    6. CAB not happy that I already done some repair work eventhough the dealer refuses to do so. Which I understand weakens my case.
    7. Only a inspection of the DPF will prove if my driving style is causing the light to come on or the DPF is so clogged up it needs replacement which proves on a balance of probabilities the fault was there when he sold me the car.
    8. I want to keep the vehicle & I want to negotiate a reduction in price as advised by CAB but the dealer has made this impossible with his antics.

    I don't know what more advice you want. You keep telling us his behaviour is unacceptable and that you're prepared to take it to court. His behaviour is unacceptable. Cut the emotional and xenophobic nonsense and get on with it.

    Either issue a claim or forget about it and move on. Recounting the sorry tale on a web forum isn't helping. Sending another letter will be pointless.

    Seriously I've come onto this forum looking for advise instead I'm called a xenophobe, my intelligence insulted & my actions questioned. Seriously I didn't come here looking to share a sob story. This is a consumer forum but instead it feels like you long time users are just ignorant snobs who think you can belittle anyone here. You long term users on this forum are no different then the rogue traders that plague our society. I'm no longer posting here any longer so @Admin delete my thread.
