Faulty second hand car advice needed

I need some advice regarding how to approach this.
I purchased a second hand car from a used car dealership. After 2 days the nearside window stopped operating. The dpf light came on three times within 3 weeks of putchase. I contacted the dealer to reject the car under 30 days consumer law. He refused my request. I asked for a repair or he part pays towards a repair he refused.
I paid for the window repair which ran £339. I rang citizens advice who told me to send a letter to the dealer. I did this with a copy of the repair invoice. I checked online & he received the letter.
The dealer rang me today basically threatening to come to my home & beat me up. I left a negative review & he wants it removed. He denied receiving my letter. I asked him nicely if he would pay the repair cost which he now says I should come to him have repair work done. He continued to verbally abuse me.
I now at lost at what to do. I can continue taking legal action but this dealer has threaten me to the point that I am frighten. I have a young family & children to care for.
Should I report this to the police . I paid a £110 deposit on the credit card & I might try section 75 but this might fail because I've already had repair done.
I'm prepared to live with the dpf fault but want the repair cost back.

The phone call also proves he got your letter. Carry on taking him to court - you have him rattled. He is very unlikely to come to your home, but if he does and appears angry, call the police.
You also need to report his threat to the police. Be careful opening the door to strangers. Fit a spy-glass if you need to so that you can see who is at the door. If he comes to the door and is calm, and says he wants to discuss the matter, I would suggest that you suggest he meet you in a local cafe in 10 minutes and make your own way there. I would not let him into your home. The comments I post are my personal opinion. While I try to check everything is correct before posting, I can and do make mistakes, so always try to check official information sources before relying on my posts.0 -
I am going to report this to the police. I am also going to continue to pursue legal action. It amazes me that in 21st century Britain !!!!! style intimidation tactics are still used. If we don't challenge this behavior we will get no where. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0

usually by people that dont get their own way .
Or the vote goes against them .
As you say this is a Dealership then a letter to the Dealer Principal and a copy to the manufacturer that owns the Franchise .0 -
I'm going to suggest that use of the term "dealership" was loose, and that this was probably an Arthur Daley outfit ... a franchised dealership would not act in the way the OP outlines, hence it is highly unlikely that a Dealer Principal exists.0

Its like one of those used car dealers that appear on sherrifs are coming. I did request a copy his complaints & ADR details but he did not know what I was on about.
I did warn him of my cause of action. The guy looks foreign. Not to sound bad but if your going to do business in the UK you have to follow the law. You can't call your customer & intimidate them. Does not work like that here in the UK.This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -

He has and will continue to do so until action is taken.0 -
Just some advice needed. Before court action its recommended to use a ADR to mediate but the dealer does not belong to any motoring groups or a mediation scheme actually I requested this a few times in my calls to him but he does not know what ADR is. His website does not list any complaints procedure. According to Trading Standards website if he sells his goods online then he is legally obliged to have a complaints procedure and ADR scheme available under the Consumer Rights Act. Although I requested such details again in my letter which he denies receiving although tracking shows he did. I don't want to negotiate with him any further after he threaten violence towards me and my young family. This is a system account and does not represent a real person. Whatever the dealer's heritage, nationality or status, I doubt his behaviour is as a result of him "looking foreign". I expect you can find dodgy and threatening characters from all walks of life if you're unlucky.proffk wrote:It amazes me that in 21st century Britain !!!!! style intimidation tactics are still used. My reasons for saying he is foreign is because he may not understand the consumer laws if you sell in the UK if he came to trade from abroad.
The citizens advice consumer line are no help. After I requested further advice on what to do after he denied receiving my letter. They insisted I contact him again by letter eventhough the guy verbally threaten me if I continue to pursue this .Getting a repair is out the question now since he did this & I repaired the window which citizen advice claim has reduced my case. I will just have to keep the car & request a fair reduction in price because the dpf fault is still present.
I'll have my local volkwagen dealership to do a report on my dpf which should indicate if there is a fault with it & strenghten my case. I'm prepared to fight this all the way to court. I'm from a complaints background & I've won immigration tribunels in the past so this does not phase me.This is a system account and does not represent a real person. There are 2 stages of a Small Claims, 1. Winning 2. Actually getting your money if you do win. 2 is often more difficult to achieve than 1 where a trader with a dubious reputation is involved.
Finally, he is not selling his goods online, he is advertising them, the actual transaction takes place at his premises. If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0
