In the appeal text just say you are the keeper not the driver

"Also, the website asks if you are the driver or not and doesn’t let you send the appeal without choosing a tick box and if you tick ‘no’ it asks you to name the driver "

It's on their portal once you enter details and on their paper work

OK, maybe the OP should ask the ICO about this as there is no reason for them to access data

This is a screenshot of the F1rst appeal portal when you click ‘no’ as the driver. And it also shows where they say they may conduct a credit search.

Put 'none of your business' or 'driver will not be named' in the 'driver' box and carry on with the appeal as keeper.

Then email Gemma Dorans to complain to the BPA, as they CANNOT make the driver's name a condition of appeal, so that page needs to be changed:

    gemma.d@britishparking.co.uk

Gemma has always been fair IMHO and will look into this, if there is no clear option.

But looking at this link, it is NOT insisting on being told who was driving?

If it lets a keeper continue then that is OK.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

So would you suggest sending the template appeal even though they provide pictures of the car/signage on their portal and waiting for the POPLA code to send a proper appeal with picture evidence or should the keeper change the format of the template slightly?

    See post #2
  • Sent the appeal and the keeper has just received a reply from them by email. The email is asking for a driver to be named, this is the body of the email...

“We acknowledge receipt of your appeal against above PCN number. In this appeal you have not stated the driver at the time of the contravention, therefore please provide us with a full name and serviceable address to enable us to pursue the driver.

If you fail to deliver this information within the required timeframe (today’s date) as stated on your NTK (date of NTK), the registered keeper will be liable for this PCN under paragraph 9(2)(f) of Schedule 4 of the Protection of Freedoms Act 2012.”

They have not sent a POPLA code either. Any help with what to reply to them?

Nothing. Sit tight. They are fishing for the drivers details, which you don't want to give.

If you really feel you must respond tell them the driver will not be named and send a POPLA code.

Phishing email and cannot restrict giving a POPLA code
They don't know who the driver is/was and you can have great pleasure in ignoring them

If you do not get a POPLA code, it's a direct complaint to the BPA
